Dear Mr Burton

Environmental Information Regulations 2004 - Information request

We have now considered your request below;

You asked:
This is to ask for a copy of the full specification for the procurement of maintenance services for parks and open spaces in Merton and Sutton from id verde UK signed in January 2017. This should include all schedules and appendices.

Our response
Regrettably we are not able to disclose the full specification for the procurement of maintenance services for parks and open spaces in Merton and Sutton.

We are applying exception Regulation 12(4)(d) as this applies to material that is still in the course of completion, unfinished documents or incomplete data. This has been interpreted to mean that, whilst a particular document may itself be finished, it may be part of material which is still in the course of completion, in which case the exception may be engaged for all documents forming part of that process.

Merton Council have concluded that release of the information requested that is incomplete would not reflect the true nature of the finished documents or the Local Authorities final position. This could cause disproportionate and undue public concern around this particular project. We are of the view that the public interest in withholding this information outweighs the public interest in it’s release.

If you have any queries or concerns about this please contact me.

If you are dissatisfied with the handling of your request please contact
Graham Owen, the Head of Information Governance at Merton Council, Civic
Centre, Morden, SM4 5DX or e-mail [1][Merton Borough Council request email]

If you remain dissatisfied with the handling of your request or complaint,
you have a right to appeal to the Information Commissioner at:

The Information Commissioner's Office, Wycliffe House, Water Lane,
Wilmslow, Cheshire, SK9 5AF.
Telephone:0303 123 1113 Website: [2]www.ico.org.uk

There is no charge for making an appeal.

Dear Merton Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Merton Borough Council's handling of my FOI request 'Final specification for procurement of parks and open space maintenance services'.

This information relates to a contract which was signed in January 2017 and began on 1 February 2017. It is unclear therefore why it is considered to be "material that is still in the course of completion, unfinished documents or incomplete data".

Moreover, Merton Council's Director of Environment and Regeneration, Chris Lee, committed the Council to publishing this information at a meeting between Merton Council, contractors idverde and Friends and like minded groups on 30 November 2016 . It is unclear whether and why this commitment has been withdrawn.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/f...

Yours faithfully,

Dear foi,

I should welcome an update on my request on 13 February for an internal review of the refusal of my freedom of information request. I am keen to avoid escalating this to the Information Commissioner.

Dear Mr Burton

Re EIR Review

I refer to your request dated 16 January 2017, for information about the
procurement of maintenance services for parks and open spaces.

In response to your request, please refer to the attached documents
(comprising 41 files).

As you have been previously advised, a number of further appendices remain
under review, as they contain both commercial data (including that of a
third party Sutton Council) and personal data which may need to be
redacted.

Merton Council additionally holds .Map files in relation to this matter.
However, these are not attached due to their large file size. Please
advise, should you seek to have copies of these files disclosed to you.

Yours sincerely,

Merton Council

Dear Chris Warner,

Thank you for your further consideration of my request. I welcome the release of some of the information and recognise the reasoning for not releasing a small amount of information.

This is to confirm that I would like to receive copies of the map files - ideally through zipped files via What Do They Know.

Please will you confirm whether these are the only remaining files that need to be released or whether there are others for which some information is still to be redacted.

Yours sincerely,

Tony Burton

Doug Napier, Merton Borough Council

Tony:

Regards the outstanding issue of the large map files mentioned below, I've now discussed this matter with colleagues here. What's been agreed at this end is that we will transfer the map files to a memory stick - this is being done as I type this note and may even be done already. This will be available for you to collect at your convenience from the Civic Centre from tomorrow morning.

The completed memory stick will be lodged with our Information Governance team for collection. Please assume that is the case unless you hear otherwise from us again in the interim. Graham Owen, the manager of that team, is aware of this arrangement for supplying you with this data.

It is my understanding that these are the final items to be supplied to you by us as part of this enquiry.

Kind regards,

Doug Napier
