Our response
Regrettably we are not able to disclose the full specification for the procurement of maintenance services for parks and open spaces in Merton and Sutton.

We are applying exception Regulation 12(4)(d) as this applies to material that is still in the course of completion, unfinished documents or incomplete data. This has been interpreted to mean that, whilst a particular document may itself be finished, it may be part of material which is still in the course of completion, in which case the exception may be engaged for all documents forming part of that process.

Merton Council have concluded that release of the information requested that is incomplete would not reflect the true nature of the finished documents or the Local Authorities final position. This could cause disproportionate and undue public concern around this particular project. We are of the view that the public interest in withholding this information outweighs the public interest in it’s release.

I am writing to request an internal review of Merton Borough Council's handling of my FOI request 'Final specification for procurement of parks and open space maintenance services'.

This information relates to a contract which was signed in January 2017 and began on 1 February 2017. It is unclear therefore why it is considered to be "material that is still in the course of completion, unfinished documents or incomplete data".

Moreover, Merton Council's Director of Environment and Regeneration, Chris Lee, committed the Council to publishing this information at a meeting between Merton Council, contractors idverde and Friends and like minded groups on 30 November 2016 . It is unclear whether and why this commitment has been withdrawn.

Regards the outstanding issue of the large map files mentioned below, I've now discussed this matter with colleagues here. What's been agreed at this end is that we will transfer the map files to a memory stick - this is being done as I type this note and may even be done already. This will be available for you to collect at your convenience from the Civic Centre from tomorrow morning.

The completed memory stick will be lodged with our Information Governance team for collection. Please assume that is the case unless you hear otherwise from us again in the interim. Graham Owen, the manager of that team, is aware of this arrangement for supplying you with this data.

It is my understanding that these are the final items to be supplied to you by us as part of this enquiry.
