However, I note that your statement was not accompanied by the two letters I have you to provide as relevant to this request - surely just a case of attaching them.

- a copy of the letter in its final form

- the copy of the draft letter which was attached to your email to Defra on the day of Quarterly Grant Agreement Meeting Wednesday 9 December 2020

received on 22/10/2021 and this has been amalgamated with your previous
request received 04/10/2021 as per our rights within the Act due to them
both being related to same subject. Under the terms of the Act you are
entitled to a response within 20 working days of receipt.

 

If for any reason we are unable to meet this deadline we will keep you
fully informed of the reasons for this and will tell you when you can
expect a response.

Dear Canal & River Trust,

I am writing to request an internal review of Canal & River Trust's handling of my FOI request 'Final Heritage letter - not sent'.

Canal & River Trust is subject to Environmental Information Regulations and also subject to the Freedom of Information Act 2000 with respect to functions inherited from British Waterways. The Canal & River Trust have undertaken to voluntarily release information where they can regardless of whether they are obliged to do so.

You have responded under FOI only.

I am also concerned about your statement on amalgamation which suggests you intend to delay as long a possible and eventually refuse the request on spurious grounds of cost or vexatiousness (which will cause yet more delay).

I would ask the reviewing officer to consider my request under FOI, EIR and voluntary disclosure and provide me with the two documents requested.

I would ask the reviewing officer to explain why I am told that this request is being amalgamated but no refusal notice issued.

This is a very simple request for two documents held by Tom Deards.

I can confirm that the Trust has 20 working days to respond to your request. I therefore make the deadline the 22/11/2021 . I shall however endeavour to provide a response sooner than that.

Dear Joshua Fellows ,

I confirm that one of the two letters was first requested on 23 August. After delaying, the request was eventually refused on the basis that the letter was not sent. The "not sent" letter was requested again more than two weeks ago on 12 October together with a second letter as being being relevant that original request. This was ignored so this fresh request has been made.

To the best of my knowledge this information should be made available under FOI and EIR.

I would, therefore, ask that this request for review is not used as an excuse to further delay provision of these two letters which I understand are held by Tom Deards.

Please provide the two letters via whatdotheyknow.com in the original format (.docx) rather than converting them to another format.
