In a recent report on Border Television, it was reported the final cost of DG One to Dumfries and Galloway Council (or rather Council Tax payers) amounted to £20,000,000. Can you please confirm that figure to be correct?

What was the total cost of the rebuild?

How much of this was met by Kier, or any other contractor?

Please provide a breakdown of the amount borne by the council, which will be paid by Council Tax payers eventually?

Please do not insult your Council Tax payers by refusing to provide this information.

I acknowledge receipt of your communication dated 31 January 2020.

Whilst I appreciate you need to establish the situation, however it is felt the time limit you suggest for reply, 3 March 2020, is rather excessive. This request was made to you on 4 January 2020 and the time limit for reply is 20 days under the Freedom of Information Act. I shall be grateful if you will endeavour to provide the information as soon as possible. It is in the public interest for this information to be available given the fact Council Tax payers will be required to foot the bill.

Please accept our apologies, the previous email fails to state that this request is not being considered under Freedom of Information (Scotland) Act 2002 (FOISA) but under the Environmental Information (Scotland) Regulations 2004 (EIR).

The EIR also specify that public authorities have a duty to comply with the following regulations ‘as soon as possible and no later than 20 working days after the date of receipt of the request’ except when;

Under Regulation 7(1)(3) – there is a requirement to notify the requester that the authority needs an extension of time to deal with a request which is complex or voluminous.

The EIR permit an extension to the time for compliance for Regulations 5(2), 6(2)(a) and 14(2), from 20 to 40 working days, where the authority believes that the complexity and volume of the request would make it impractical to comply or reach a decision about whether to refuse the request, within 20 working days.
