Final Charging Order registration

Response to this request is long overdue. By law, under all circumstances, HM Land Registry should have responded by now (details). You can complain by requesting an internal review.

about Interim Charging Orders and Final Charging Orders being required to
be registered with the Land Registry.

 

Your request is being dealt with under the terms of the Freedom of

Please provide all information you hold that confirms that both Interim
Charging Orders and Final Charging Orders are required to be registered

Our response:

We do not hold the information that you have requested.

We do have a Practice Guide (no 76) which contains guidance on charging
orders. The following link will take you to the document on our website at

The Practice Guide explains Land Registry’s practice and procedure in
relation to applications made for the entry of a notice or restriction on
the registered title in respect of a charging order. There is no
requirement to make an application in respect of both interim and final
orders and HM Land Registry may not always be informed of the type of
charging order (interim or final) because it is not specified in the
application.

 

If you have any queries about this letter, please contact me.  If you are
dissatisfied with this response to your request, you may seek an internal
review within two months of the date of our reply. Internal reviews will
be dealt within 20 working days. If at the end of this time we are unable
to respond, we will write to you explaining the reasons and giving you a
