Film sets being constructed in Black Park

I understand that a number of film sets are being constructed in Black Park. As sets are being constructed, this affects the elements of the environment as defined in regulation 2 of the Environmental Information Regulations 2004 because it involves changes to the land and landscape, among other things.

Please provide the following information under the Environmental Information Regulations 2004:

1. A copy of the application for the filming and documents of the following types submitted by the production company:
(a)health and safety policy/risk assessment/method statements;
(b) vehicle registration numbers and identifying logo;
(c) a letter of intent outlining what the production will involve.

2. Please provide a map of the areas of Black Park that are being used for filming.

3. Please confirm whether the council has authorised use of CCTV to protect the areas to be used for filming. If so, please provide the identity of the data controller and the identity of any data processor who is responsible for operating the CCTV system.

Your request for information has now been considered and our response
follows.

 

Please note that just because some parts of a request might be considered
'environmental' (and in this case we would observe that any impact on the
environment is temporary by definition), it does not mean that all the
questions in a request automatically fall due to be dealt with under the
EIR. Indeed, the majority of this request is a FOIA matter.

 

1. A copy of the application for the filming and documents of the
following types submitted by the production company:

 

This is commercially sensitive information and therefore only redacted
licences are attached.

 

(a) health and safety policy/risk assessment/method statements;

 

Redacted statements/assessments are attached with personal/commercially
sensitive information removed.

 

(b) vehicle registration numbers and identifying logo;

 

This information is not collected by BCC – production companies are
expected to adequately manage vehicles on site.

 

(c) a letter of intent outlining what the production will involve.

 

The precise details of the sets would be considered as commercially
sensitive and therefore are not available, however the production
company(s) have applied for and been granted permission to ‘dress’ the
filming location and construct assorted sets so that the selected section
of the park accurately represents a fictional location described in the
screen play or script for the particular production. These constructs can
represent various areas of this world or beyond. These proposals are
considered by the on-site team and approval is given or rejected depending
on their professional opinion on the suitability of the proposals for the
site.

 

The basis of the refusal is as before, but we repeat this below for
convenience:

 

We have redacted some parts of the material under Section 43(2) and the
equivalent Regulation under the EIR - R.12(5)(e):

 

Information is exempt information if its disclosure under this Act would,
or would be likely to, prejudice the commercial interests of any person
(including the public authority holding it).

 

We believe disclosure would prejudice the Authority's interests:

 

Disclosure would seriously damage the Country Parks service's reputation
in the filming industry (where there is an expectation of sensitivity) and
could jeopardise future filming activity/income on which the parks'
self-financing relies.

 

We believe disclosure would be likely to prejudice the production
company's interests:

 

- filming is a commercial activity

- some details of the approach taken to a particular filming would be of
interest to competitors, as it reflects the expertise of the production
company and would potentially allow competitors to modify their approaches

- information on who and what is filming is commercially sensitive and
disclosure might be a security risk to the production

- we would not normally disclose intended dates/types of filming as fans
can potentially disrupt filming and lead to delay and additional booking
requirements and cost, indeed, we know this does and can occur from our
own experience in the past (with the Harry Potter films)

- productions rely on secrecy to protect the integrity of the end product

 

We do recognise that there is a public interest in openness and
transparency, especially where a public asset is being used. However, we
equally note that the majority of the park will still be available for
public enjoyment, and the continued enjoyment of these assets relies in
part on the funding which filming activity provides.

 

Filming is an important source of income for the Country Parks and helps
fund the onsite ranger team, site maintenance and conservation work. We
recognise that the film industry can have an impact on the parks and we
work closely with the film productions to minimise and offset this and put
suitable controls in place to protect areas of the park.

 

Ultimately, there is a difference between information that interests
certain members/groups of the public and the general public interest. We
can see little general public interest in disclosing the specific redacted
information as, for instance, any health and safety concerns attach to the
production and not the general public who are protected from entering the
filming area.

 

Consequently, we believe that the public interest rests with
non-disclosure of the redacted/exempted/excepted material.

 

2. Please provide a map of the areas of Black Park that are being used for
filming.

3. Please confirm whether the council has authorised use of CCTV to
protect the areas to be used for filming. If so, please provide the
identity of the data controller and the identity of any data processor who
is responsible for operating the CCTV system.

 

No CCTV permissions have been requested or granted and to our knowledge no
CCTV monitoring is in use with the filming activities on Bucks Country
Parks.

The Country Parks Team did not authorise the use of CCTV on BCC land that
forms part of the Country Parks for any film production shooting in Black
Park in 2018. We are aware that a film production had Heras fencing
delivered from another site that had signage on it referring to guard dogs
and CCTV and we asked for this to be removed which it was.

 

I understand that we would not be able to comment in respect of any
arrangements beyond the country park.
