To the extent that any data we hold in connection with your information
request relates to you, it comprises your ‘personal data’. As a result we
will treat your request as a ‘subject access request’ made under the Data
Protection Act 1998 (DPA).

However, if there is additional information held that falls in the scope
of your request which is not your personal data, we will still consider
whether this should be provided to you under the terms of the Freedom of
Information Act 2000 (FOIA). 

It is important to note that a release under FOIA is applicant blind and
therefore effectively a release to the wider world. We will therefore also
consider the release of any information that it might be reasonable to
disclose on a discretionary basis.

Whilst an organisation must respond to a subject access request promptly,
and in any event within 40 calendar days, we would hope to be in a
position to respond to your request within the shorter timeframe required
by the FOIA (20 working days from the day after we received your
request). Therefore, as we received your information request on 28
January 2014 we hope to respond by 25 February 2014.
 
You have made your request for information via this website. If it
transpires that your information request contains personal data, we will
only communicate with you at your personal email address.

2. Fails to supply a Decision Notice after an FoI request a involving a stakeholder.

3. And then fails to remedy the situation .....by still not producing the missing DN ..yet again.. in January, who do I complain to?

This case is now over two years old.... And still no decision notice.

And I still can't find out the background to why no DN was issued, as the ICO has not met its statutory deadline on the provision of information.

I can confirm that the ICO will draft a decision notice in respect of your above referenced complaint against Powys Teaching Health Board ('PTHB'). I can't understand why the organisation tasked with openness transparency and candour in processing the FoI and DP Acts .....doesn't.

Still being promised the Decision Notice ( since a December).

I can't think what the hold up is.

In addition, I wanted to put in evidence from the ICO files, to the external PHSO investigator.

Sadly I was prevented from doing this - as the ICO didn't confirm to its own response dates and the investigation finished before I could provide the missing information..

So does the retention of these documents have any bearing on the fact that my case with the PHSO ......concerns maladministration by the ICO?

Anyone would be suspicious.

But overall, how on earth can the ICO monitor other government bodies if it doesn't comply with the law itself?

Still waiting for the Decision Notice....

Good job the Ombudsman has asked the ICO to investigate why the ICO delayed a Decision Notice - potentially involving one of it's own stakeholders - for over two years.

Because there was no sign that it would do so otherwise.
