* The area of land that Highways England Ltd acted as the agent for the landowner in felling licence 018-366-15-16).
* Felling licence 018-366-15-16 enables about 150,000 m3 of timber to be felled what proportion of felling has taken place.
* What amount of money has Highways England received for the management of trees under felling licence 018-366-15-16 from organisations of common good (i.e Rural Payment Agency, European Commission, etc.)

Unfortunately, I am unable to proceed with your request without
clarification of the information you wish to receive. We have numerous
road projects in various stages of development and felling licence
information is not held in a central location. With this in mind, please
can you clarify either the name of the road scheme or the approximate
whereabouts of the land in question so I can determine which project team
is best placed to deal with your request.

 

If I do not receive appropriate clarification of your information

Felling licence 018-366-15-16 is a national licence awarded to Highways England following an application being made in 2015 by Highways England. The licence includes land for which at least 100 local authorities are identified as being responsible.

The licence was applied for centrally and as such the information requested should be readily available..

I am writing to request an internal review of Highways England Company Limited's handling of my FOI request 'Felling Licence 018-366-15-16'.

Highways England applied for a felling licence in 2015 from Forestry Commission.

The land mapped as being part of the consents granted is identified by the Forestry Commission on their website (https://www.forestergis.com/Apps/MapBrow...)

The land owned by Highways England is mapped by who Owns England on their website: http://map.whoownsengland.org/

Highways england when making the felling licence application (not covered by the Memorandum of Understanding) certified:

*) none of the land was subject to a TPO
*) I (Highways England) am the applicant, or an agent acting on the applicant's behalf, and have sufficient control over the land on which the trees are growing to fell the trees with or without the consent of any other person.
* I (Highways England) have made the necessary checks with local planning authorities regarding tree preservation orders and conservation areas and English Heritage with regard to any Scheduled Ancient Monument.

1. the land registered to Highways England does not tally with the felling licence (i.e. try postcode ME13 9LN) which is also claimed to be subject to a TPO.
2. Highways England should have a lot of agent forms for its licence.
3. A felling licence enables payment of European funding to the applicant or match funding identified. The sums are likely to be considerable. I have no doubt that the shareholder in Highways England viewed this as being cost effective.

Provision of the requested information is in the public interest.. and should be easily available to Highways England. The Forestry Commission has identified that a felling licence runs with the land..
