Freedom of Information Request

I am writing regarding your Freedom of Information Request relating to
alleged FCHO Fly tipping policy ref 435916 reported to FCHO CEO Donna
Cezair.

FCHO transferred from the ownership of Oldham Council in February 2011.
FCHO is a Co-operative and Community Benefit Society and is registered
with the Financial Conduct Authority as a Mutual Society. FCHO is a ‘not
for profit’ housing association and is an exempt Charity regulated and
accountable to the Regulator of Social Housing.

The Freedom of Information Act 2000 provides public access to information
held by public authorities as defined in section 3 of the Act.
Unfortunately, however, First Choice Homes Oldham is not classed as a
public body under the said Act and it is therefore not legally obliged to
provide any information to you.

Notwithstanding the above, FCHO have investigated this matter and can
confirm that no property on Sunfield Road, Oldham OL1 3BS, in particular
number 73, has been refurbished recently either by FCHO employees or any
contractor acting on behalf of FCHO.

Subject: Environmental Information Regulations request - FCHO Fly tipping

Dear Ms Donna Cezair,

First Choice Homes Oldham are refurbishing a flat on 73 sunfield Rd OL1
3BS, the staff/contractors are putting all the building rubbish in the
black bin that belongs to 79 sunfield Rd OL1 3BS the bin is not for
commercial waste and the bin is so heavy and very difficult to move.

Please can First Choice Homes Oldham remove the building rubbish from the
bin that belongs to 79 sunfield Rd OL1 3BS and dispose the commercial
rubbish correctly.

I would like FCHO to provide a copy of the policy for removing building
material?

Can FCHO use non commercial black bins for disposing building material?

On how many occasions has FCHO CEO Donna Cezair been made aware complaints
against staff/contractors not correctly disposing building material?

According to FCHO policy if staff/contractors are incorrectly disposing
building material what action would FCHO take?
