I am writing to request an internal review of f c a 's handling of my FOI request 'FCA failed to warn investors of lending abuse by collateral'.
It is evident that you have failed to address my FOI request in a proper and lawful way. Instead you have repeated superficial statements about Section 14 of the FOI Act applying without providing any information or evidence whatsoever as to how it could conceivably apply. It is a concern that you continue to make simplistic assertions without explaining what those assertions are founded on.
The various grounds for my appeal are as noted in the following paragraphs:
There is nothing in this request that could reasonably indicate it to be vexatious under Section 14 of the FOI Act. Indeed, you have failed to provide any reasoning whatsoever and this failure may also indicate that
you have acted improperly in applying a blanket refusal, in breach of the FOI Act. Your repeated failure to provide reasons also fails to have proper regard to the ICO’s advice regarding about providing explanations to be helpful to the requestor in these circumstances when the authority seeks to use Section 14.
This is a perfectly reasonable request for information held by a public authority, which is readily available and a matter of significant interest to both myself and the public generally, so there is nothing remotely
frivolous or lacking purpose in this request.
Therefore, please undertake an internal review as quickly as possible, and in any case within 20 days as expected, noting this request for review is issued to you today, 21 November 2023.
Please note that neither 'reputational damage' nor 'embarrassment' are recognised exemptions under the law. FCA FOI is expected to apply the law properly without introducing special considerations for the FCA - it is subject to the law in exactly the same way as every other relevant authority”.
I also formally note that your response was not provided in a prompt manner as required under the legislation (please refer to the FOI Act). The Act and guidance seeks to ensure much better turnaround performance, especially given the lack of any discernible reasoning and the blanket refusal under S14.

We have processed your request under the provisions of the Freedom of
Information Act 2000 (FOIA) and our response is below.
Question 1
On 1 April 2014, responsibility for regulation of consumer credit and
related activities was transferred from the Office of Fair Trading (OFT)
to the FCA. Any person (including a firm) who held a Consumer Credit
Licence immediately before 1 April 2014, on notifying the FCA of certain
required information and paying any relevant fee before 1 April 2014, was
granted ‘interim permission’ to carry on consumer credit activities.
Firms carrying on consumer credit activities under an interim permission
and wishing to continue to do so after the transition period were required
(before 31 March 2016) to apply to the FCA for full authorisation. Firms
with interim permission appeared on the Interim Permission Register (‘IP
Register’).
On 1 April 2014, Regal Pawnbrokers Ltd was granted interim permission
under the reference number 656714. On 12 November 2015, the IP Register
was amended by one of the Collateral directors, Peter Currie, so that the
name of the firm holding interim permission reference number 656714 read
‘Collateral (UK) Ltd’ (‘Collateral’). The change of company name on the IP
Register was not a legitimate means to transfer the interim permission
from Regal Pawnbrokers Ltd to Collateral.
On 23 March 2016, an application for authorisation was made by Collateral.
It was actively considered by the FCA from April 2016 onwards. On 23
November 2017, during the review of Collateral’s application, it was
identified that Collateral was not the holder of a valid interim
permission.
Question 2
Between 23 November 2017 and 29 January 2018 (when the FCA took action
against Collateral and amended the Interim Permission Register), the FCA
had been engaging with internal stakeholders to establish the action that
should be taken.
Additionally, the FCA was engaging with the firm for the purpose of
informing its customers that it was not authorised by the FCA and
instigating a controlled wind down of the loan book. The FCA did not
immediately require Collateral to cease business because of the risk that
an immediate cessation of business could cause a disorderly collapse which
would cause harm to customers (when it might have been possible to avoid
such an outcome).
By January 2018, it was apparent, despite the efforts of the FCA, that
there was unlikely to be an agreed resolution to the dispute with the
directors of Collateral and on 29 January 2018, the FCA wrote to
Collateral directing them to:
• cease conducting regulated activities;
• cease advertising itself as being authorised by the FCA;
• make the correct position known to its customers; and
• to provide a full customer list to the FCA.
On the same day, the IP Register was changed to display the correct
details.
Question 3
We can confirm that we have received complaints concerning Collateral (UK)
Ltd and are investigating the matter. As our investigation is ongoing
(although nearing its final stages), we do not hold recorded information
which would answer this question. We will of course continue to update
complainants in accordance with the Complaints Scheme and we are working
to finalise the complaints investigation as swiftly as we can.

I am writing to request an internal review of fca foi's handling of my FOI request:
FCA FAILED TO WARN INVESTORS OF LENDING ABUSE BY COLLATERAL
My appeal specifically concerns fca foi's response to Question 2 of my FOI request. My grounds of appeal are:
1. Appeal Ground 1 is that your response to Question 2 appears to misrepresent the position. The response to Question 2 says “Additionally, the FCA was engaging with the firm for the purpose of informing its customers that it was not authorised by the FCA and instigating a controlled wind down of the loan book.”
Question 2 specifically concerns the period between 23 November 2017 and 29 January 2018. It is evident that the FCA was not at any time during that period “engaging with the firm for the purpose of instigating a controlled wind down of the loan book”.
In fact, my understanding is that the 29 January 2018 letter recognised Collateral’s ongoing and long-standing application for authorisation. It left the issue of whether Collateral’s operation involved regulated activities open, and therefore a wind-down of the loan book had not been instigated or suggested by that date. Furthermore, it is evident that, apart from the 29 January 2018 letter, the FCA did not engage with Collateral at all between 23 November 2017 and 29 January 2018.
2. Appeal Ground 2 is that in response to Question 1 of my FOI request, you noted: "On 23 March 2016, an application for authorisation was made by Collateral. It was actively considered by the FCA from April 2016 onwards. On 23 November 2017, during the review of Collateral’s application, it was identified that Collateral was not the holder of a valid interim permission". However, there appears to be no evidence whatsoever that the application was indeed "actively considered" from April 2016 onwards. In fact, I understand that the FCA letter of 29 January 2018 acknowledged that the FCA had been unable to progress consideration of the application in a timely manner.
3. Appeal Ground 3 is that you have not provided the letter of 29 January 2018 referred to in your response and that this letter should have been provided, and should now be provided to ensure proper understanding in context having particular regard to points 1 and 2 above, where assertions made in your FOI response appear to be contradicted by the available evidence.
TO ENSURE CLARITY, my first ground of appeal is that your response of 12 July 2024 to Question 2 appears to say that the FCA was engaging with the firm and instigating a controlled wind-down and it appears that may not be accurate and that no such wind-down was being instigated during the period noted. My second ground of appeal is that it appears that the FCA's letter of 29 January 2018 may have acknowledged the FCA's delay of almost two years in determining Collateral's application and therefore the FCA's failure to progress the application would have been a key causal factor in the ensuing problems that arose and that this should have been noted in the FCA's response to my FOI. As well as providing me with a copy of the 29 January 2018 letter, please provide any evidence that the application was being "actively considered" by the FCA from March 2016.
