Thank you for your request for information under the Freedom of Information (Scotland) Act 2002. In order that we may progress your request, please could you clarify what you mean by 'the current number of Fatal Accident Inquiries which have not been assigned to a Sheriff'?

It may assist if I explain that the Scottish Courts and Tribunals Service (SCTS) only holds information in relation to Fatal Accident Inquiries (FAIs) which have been presented to the courts by the Crown Office and Procurator Fiscal Service (COPFS). The responsibility and authority for investigating deaths lies with the COPFS, and after their investigations into a death have been made, the COPFS will make a decision about whether to present an application for a Fatal Accident Inquiry to the courts. Prior to such an application being made, the SCTS does not hold any information in relation to deaths which are still under investigation by the COPFS. Information in relation to such investigations may be available from the COPFS.

If this is not the information you are seeking, please could you advise what information it is you wish to request? Once we receive your clarification we will be in a position to proceed with your request.
