Although the second submission itself was sent to DCLG electronically, the appendices were sent as hard copy because they are so extensive and because of some of the formats (i.e. DCLG received a lever arch folder of all the associated paperwork).

I do have a spare folder that I can send to you directly if you provide a postal address or, if you are local to Watford, the council can arrange for it to be hand delivered.

Thank you for your response of the 3 December 2013.

I do appreciate that you may think it easier to post me the additional appendices. However, I would then be in a position myself of having to scan them in separately and upload them onto the What Do They Know website against this particular request, something I am sure the Information Commissioner would take a dim view of as the files you refer to will all be electronically held the Watford Council and easy to attach and upload onto this website.

Also, as you will see, the Department for Communities and Local Government made a similar suggestion to release appendicies in a different format to a previous request to release Watford Council's first submission in relation to Farm Terrace allotments - https://www.whatdotheyknow.com/request/a... . In this case, when H.Keegan explained that the upload facility on this site was perfectly adequate, the appendices were then uploaded. Further information regarding uploading files can be found on at https://www.whatdotheyknow.com/help/offi... .

I would of course not want to refer your response to the Information Commissioner whilst at the same time referring the Commissioner to the previous response made by the Department for Communities and Local Government.

With this in mind I would expect Watford Council to upload the appendices without delay.

As you did not specify how you wanted the information sent, my proposal was to send the information in the same format as that received by the Department of Communities and Local Government (which was not electronically). I understand from your email that you prefer the information to be uploaded electronically to the 'What Do They Know' website.

As I explained in my email of 3 December, not all the information is currently held electronically and is in various formats. It also comprises around 80 separate documents of nearly 100MB in total. The council's email account does not allow for more than 10 attachments to be sent with an email and so there will need to be numerous uploads. I will start working on this today.

I find it difficult to believe that the Council do not hold all the documents electronically. Although I cannot comment on the specific documents I assume that the only documents that would not be electronically produced would be hand written which seems strange in the modern age. The only other assumption I can make here is that the documents you refer to are from the Local Asset Backed Vehicle where you have explained in a previous response on 1 November that the Council do not hold. If so, I would be grateful if you would confirm this when uploading the remaining documents.

Additionally, these documents can easily be scanned in through a photocopier to PDF format which would not be time consuming. Lastly, the majority of electronic documents can be easily converted to PDF format so I do not see an issue here.

To be helpful I am more than willing to accept the larger documents you refer to in parts (i.e. part 1, part 2 etc) which will help with file sizes. As I also explained in my earlier email there is a help page on the “What Do They Know” website that explains about file sizes and further help that the “What Do They Know” can provide you.

Whilst I can surmise from this email what appendix 8 you are referencing - the second submission to the Secretary of State for the Department of Communities and Local Government regarding Farm Terrace allotments - I am wondering why you have headed it as you have done?

Please clarify what is meant by the 'Fake response' heading and I can consider how to respond accordingly.

In terms of the appendix 8, it was not missing. It was not available at the time of submitting the application to the Secretary of State. It was referenced as it was expected to be submitted subsequently. The council does not have a copy, hence why it was not uploaded following your original request.

I did not use the word "fake" in my previous response and as you will see from looking at this request on the What Do They Know Website there is no record of this word in my question to you dated 11 June. I can only assume that the subject heading is a server error from the website.

Moving onto my question, please can you clarify:

1. When responding to my original request why did you not explain that you were not fully disclosing every attachment although it had been referenced in the submission.

2. Whilst I appreciate that it had not been passed to Watford Council at the time of the submission why did you not find out from the Trust if they had subsequently submitted a statement to The Department For Communities and Local Government and advised me when responding. If you had then a separate request could have been made to the Trust to release the submission.

From the omission from your original response you have not fully complied with the act by not providing a full response in explaining that certain documents were missing.

We have in the past, for a period, had an issue where responses created via our online forms were internally, unintentionally, given a subject line of "fake response" by our system and sometimes this became exposed to users.

This was resolved earlier this year so won't happen again; but it appears the issue occurred on this thread before it was addressed.

Thank you for clarifying the 'fake response' issue. I have alerted the 'WhatDoTheyKnow' and they have responded.

In terms of the missing appendix, it was a genuine oversight chiefly because the appendix was not on record at the council. As you know I had a hard copy of the appendices to send to you which clearly highlighted the missing appendix. As you requested the appendices electronically - and there was a very large volume (around 80 plus) I uploaded them in batches and did not register the missing appendix at the time. It was clearly annotated as 'to follow' in the submission to identify that it was missing from the appendices sent and, as you are aware from the previous response, the appendix was never received by the council.

You may ask for an internal review of the request. You can do this either by letter or by emailing [Watford Borough Council request email] . The request will be
considered by a different officer. If you still remain dissatisfied with our response after this you may write to the Information Commissioner.

In terms of your second request, the request you have made is for an explanation regarding a decision and is not, therefore, a request for information held on record by Watford Borough Council.

In reference to my second question you may have misunderstood my request.

As it stands the Councils submission is incomplete (appendix 8 is missing) so my questions is did WHHT actually submit a response to the Secretary of State if it was not provided to the Council in time?

As it is listed as an appendix I am sure the Information Commissioners Office would not take the view that I would need to make yet another FOI request to WHHT or the Department for Communities and Local Government?
