Q2. With reference to the recent Information Commissioner's decision notice (FS50505226), in particular §21:

"21. However, the Commissioner notes that in its correspondence to him, the council confirmed that since the applicant's request, it has entered in to consultation with District Audit with regards to publishing a document it has since created which details a breakdown of the reasonable costs incurred for the court summons and liability order. In the interests of transparency, it is the council's intention that, once consultation has concluded with District Audit, the spreadsheet will be made available on the council's website and will be updated annually in adherence with DCLG's best practice guidance."

The spreadsheet to which the above refers has now been made available on the council's website and so assume that consultation with District Audit has concluded.

I would therefore like all recorded information in relation to that consultation.

North East Lincolnshire council Liability order costs

North East Lincolnshire council (NELC), an interested party in this action, fully supports HMCTS submission. The costs are raised under the Local Government finance Act 1992 which allows for costs reasonably incurred by the applicant billing authority in obtaining that order.

NELC is currently in talks with the district auditor to justify the reasonable level of costs that it incurs in bringing cases to liability order. NELC contends that £70 is a reasonable figure to cover the expense of brining an account to court for a liability order. The figure is in line with other local authorities in the area and lower than many Nationally. The Grimsby Magistrates Court has also agreed that these costs are reasonable given the work required to obtain a Liability order.

North East Lincolnshire Council does not hold any documents matching the criteria specified in your request.

Please be aware that the wording of your correspondence, appears vexatious in nature and intended to raise unfounded allegations, with no real intention to obtain information held by North East Lincolnshire Council. Dear North East Lincolnshire Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of North East Lincolnshire Council's handling of my FOI request 'Falsifying Accounts'.

The council has simply stated that it does not hold the information requested. The evidence supplied (including representations made in the matter of a High Court appeal) would lead one to believe the council hold the information.

It is therefore not unreasonable for the authority to simple state why the information it has previously indicated it will hold, isn't.

North East Lincolnshire Council is simply going out of its way to be obstructive and provoke conflict.

is a matter for the Court to decide whether or not the calculated costs
are reasonable.
District Audi suggested that costs should be reviewed on a regular basis
to ensure that any changes in activity and/or expenditure is reflected.
I trust that this Internal Review answers your queries in relation to your
request, and clarifies that your request has been handled in accordance
with the Freedom of Information Act.

Dear PPD - FOI,

The contents of your last email together with a statement made in a formal and final response to a serious complaint about NELC concerning allegations of fraud leads me to believe that the Formal Complaints Procedure is a sham.

It states in your 29 January 2014 email the following regarding NELC's Auditor contractor's involvement in the summons costs calculation:

"I have reviewed our response and have found that correspondence has been received from District Audit in relation to summons costs although this is not in the form of recorded information held by North East Lincolnshire Council.

There has not been any formal consultation between North East Lincolnshire Council and District Audit. A summary of this correspondence has been provided for your reference:

Then there is this spurious claim made by the council which supports the councils decision to find the complaint unfounded:

"North East Lincolnshire Council provided a detailed breakdown based on activity and costs on it's website for 2012/13, this was updated for 2013/14. These breakdowns have been through stringent checks both internally and by the District Auditors."

The council can not be trusted to carry out its investigations in a fair and honest way.

The council has misrepresented the Auditor’s involvement by implying it would attach some authenticity to a set of accounts supporting the reasonableness of costs when in fact the figures were not subject to audit and KPMG was not willing to have a reference to District Audit on the Council’s website.

It is safe to say that any satisfaction shown by the District Auditor would only have been based on the accounts being mathematically sound, i.e., that the figures added up. Percentage estimates will have had to be largely accepted; attributable costs, in terms of both allowable expenditure and the regulations would have unlikely played a part. Given that the matter of costs did not fall within the Auditor’s responsibilities and therefore figures not subject to audit, it is difficult to see how the council’s reference to “stringent checks” has relevance to its investigation and response.

There should be a legal requirement if they are expecting people to pay a debt for it, they could have spent it on the biscuits they ate while they typed up the summons, this seems like they won't provide a breakdown because they can't and that they made the figure up somehow...I expect a breakdown of costs for every bill...so why not provide one?
