Fake Liability orders.

Response to this request is long overdue. By law, under all circumstances, Ministry of Justice should have responded by now (details). You can complain by requesting an internal review.

Dear Ministry of Justice,

I recently received notification from my local council that a liability order for non payment of council tax was issued against myself by my local Magistrates Court. On contacting the courts I was assured that this is not the case and there is nothing on my personal file or with the courts.
The courts refered me back to the council who then refered me back to the courts.

I have requested a copy of the liability order from both the council and the courts but they accuse each other of producing the "non existent" Liability order.

If the Council produced the order they are guilty of fraud and possible perjury for producing a fake court document.

1: Please provide documentary evidence that liability orders exists.
2: Please provide me with details of who produces the liability orders.
3: Please explain why the court or the council refuse to provide me with a copy of the liability order in my name.

Thank you for your email dated the 6^th December 2017 and for your
original request dated the 3^rd November 2017, I apologise for the delay
in replying.

 

The questions you ask do not fall under the terms of the Freedom of
Information Act (FOIA). An FOIA request deals with requests for recorded
information. As you have asked for general information about the liability
orders it does not fall under the scope of the FOIA and will be dealt with
as official correspondence.

 

In response to your questions raised,

 

(1) Please provide documentary evidence that liability orders exists and
(2): Please provide me with details of who produces the liability orders.

 

 The legislation relating to Liability Orders for Council tax,  is the
Council Tax (Administration and Enforcement) Regulations 1992 and can be
viewed on the following link

The Local Authority will file with the Court the information of who they
want to bring before the Court and on what date; this is usually in the
form of a list which is then signed by the Justices Clerk and the
summonses are issued. The signature may be a wet signature, a printed copy
from a stamp or from a computerised signature dependent upon the Court
local practice. Once a liability order is granted, the Local Authority
passes the Liability Orders to the court to be signed by a Justices Clerk.
This authorises the Local Authority to send notification to the defaulter.

 

(3) Please explain why the court or the council refuse to provide me with
a copy of the liability order in my name.

 

Individual orders are not stamped by the Court or signed by a Court
official. The Court has stamped/sealed a schedule (list) of Liability
Orders which relate to a number of individuals, therefore the court are
unable to provide a sealed Liability Order. Please refer to the Council
Tax (Administration & Enforcement) Regulations 1992 which gives the
authority for Liability Orders to be made in bulk. You should contact your
local council who will be able to provide you with any further information
that you require.

Dear Mr Armatage,

Further to your email dated the 5th February 2018.

The court hears a bulk application for all non-attenders: the Council representative proves the technical requirements and gives evidence that the sums levied have not been paid.

Any defendant attending or writing to the court is dealt with individually and orders made (or not made) in their case. Their attendance or otherwise is also recorded.

The legal adviser records the overall number of liability orders made, withdrawn, dismissed and adjourned. This may be recorded on the copy printout.
