Failure to Disclose Evidence - London Tribunals

On 28 February 2016 I wrote to you and the Chief Adjudicator to express concerns that Lambeth Borough Council Parking officials were failing to disclose evidence of incorrect and missing signs when submitting evidence of alleged contraventions at the Clapham Park Road bus lane contrary to the London Tribunals Practice Manual for Enforcement Authorities (signs 953,missing signs 953.2, missing Diagram 1048, missing left lane arrow and reversed No Entry sign). The combination of these incorrect and missing signs has resulted in appeals being upheld and therefore their non-disclosure in other appeal cases will have prejudiced the appellants in those cases.

Since I wrote to you a further 13 appeals have been rejected and it is apparent from the Adjudicators' records of the hearings that the above incorrect and missing signs were not taken into consideration in these appeals and were therefore unlikely to have been disclosed by Lambeth Borough Council Parking officials.

I request that you inform me what follow-up action was taken after you received my email of the 28 February 2016 and why appeals are still being rejected even though the Lambeth Council Parking officials appear to have failed to fully disclose relevant evidence of the above incorrect and missing signs. I believe that you have a public duty to ensure that there is no procedural impropriety in Tribunal proceedings and to take action where authorities are or may be in breach of the London Tribunals' Practice Manual.
