In accordance with Section 40 (2) of the Freedom of Information Act, the
University has not been able to give the exact number where small numbers
are involved, and which could therefore subsequently identify an
individual. The University has inserted a Less than five (<5) value where
applicable.

 

Section 40 confirms that a request for personal information about other
individuals is exempt from disclosure if it does not comply with the
principles set out in the Data Protection Act 2018.  Personal data is
defined as data relating to a living individual who can be identified from
those data and includes any expression of opinion about the individual and
any indication of the intentions of the data controller or any other
person in respect of the individual.  In this instance, the University is
the data controller and it has a legal obligation to protect the personal
data of the individuals you refer to. To provide actual numbers could
allow individual members of staff to be identified and would in our view
be unfair and in breach of the first data protection principle established
by the Data Protection Act.

 

If you are unhappy with the way we have handled your request for
information, you have a right under Section 50 of the Freedom of
Information Act to ask the University to review it; however, you must do
so within 40 working days of the date of this response. Your request
should include our reference number and explain the reason for requesting

Reviewer, Legal & Compliance, University of Liverpool, Foundation
