I would like to request further information about the University’s hard services maintenance, catering, cleaning and security services.

Please can the University indicate whether each of their hard services, cleaning, catering, and security services are contracted out, or delivered in-house. If any of your hard services maintenance, cleaning, catering, and security services are contracted out, please provide the following details for each outsourced contract (in excel format):
• Contract name
• Contract start date
• Contract end date
• If there is the potential to extend the contract beyond the end date, and if so, by how many years

Dear Steve Beer,

I am writing in response to your Freedom of Information request dated 11th July 2019.

You asked:

Please can the University indicate whether each of their hard services, cleaning, catering, and security services are contracted out, or delivered in-house. If any of your hard services maintenance, cleaning, catering, and security services are contracted out, please provide the following details for each outsourced contract (in excel format):

• Contract name
• Contract start date
• Contract end date
• If there is the potential to extend the contract beyond the end date, and if so, by how many years • Annual contract value • Name of the current contractor • The contact details of the person responsible for procuring the services

Please find attached an Excel spreadsheet: Appendix A

Annual Contract Value is not included as the University has taken the view that it must rely on Section 43(2) of the Freedom of Information Act which exempts information whose disclosure would, or would be likely to, prejudice the commercial interests of any person (an individual, a company, the public authority itself or any other legal entity).

In this case Section 43(2) of the Act relates to the following:

the prejudice that the University envisages as a result of disclosure is that it would weaken its position in a competitive environment by revealing information of potential usefulness to its competitors and consequently have a detrimental impact on its commercial revenue.

Public interest test considerations:

We have considered whether the public interest in maintaining the exemption outweighs the public interest in disclosing the information. There are a number of public interest arguments that weigh in favour of disclosing the information you have sought:

The general proposition of maximising openness that the FOIA and the University aspire to;

Furthering the public’s understanding of, and participation in, the debate of issues of the day;
However, there are also public interest arguments against disclosure:

Releasing the requested information could prejudice the University’s current or future negotiation capabilities.

Releasing the requested information would undermine commercial confidence and the integrity of the University’s contract management practices.

The University concludes that the disclosure of commercially sensitive information would be likely to have the effect of weakening its position in a vibrant, competitive environment and deter customers from participating in future procurement. Therefore, the public interest in withholding the requested information outweighs the public interest in disclosure of the requested information.
