Please can the University indicate whether each of their hard services, cleaning, catering, and security services are contracted out, or delivered in-house. If any of your hard services maintenance, cleaning, catering, and security services are contracted out, please provide the following details for each outsourced contract (in excel format):
• Contract name
• Contract start date
• Contract end date
• If there is the potential to extend the contract beyond the end date, and if so, by how many years
• Annual contract value
• Name of the current contractor
• The contact details of the person responsible for procuring the services

As you may be aware, information requested under FOIA is published to the
world at large unless an exemption applies. Section 43(2) FOIA exempts
information if the publication of the information would, or would be
likely, to prejudice the commercial interests of an organisation(s). As
part of your request are regarding contracts or the contractual agreement
between Birkbeck and a private service, section 43(2) is engaged.


As s.43 is a qualified exemption, a public interest test should be
conducted to decide whether the exemption should be maintained or whether
the information should be disclosed despite the exemption. We find that it
is within the public interest for this information to be disclosed as it
promotes transparency on how the university spends its money. We also find
that it is within the public interest to maintain the exemption and not
disclose this information as we believe that this disclosure would
adversely affect the university’s ability to effectively procure services
such as these and manage its spending correctly.


Therefore, on balance of the public interest for and against disclosure,
we have decided that the public interest in maintaining the exemption far
outweighs the public interest in disclosure. Therefore, the information
regarding the remainder of your request is exempt from public disclosure.


If you are dissatisfied with the handling of your request, you may wish to
contact the Freedom of Information Office in the first instance to see
whether your concerns can be resolved informally. You also have the right
to request a formal internal review that will consider the way in which
your request has been dealt with. Requests for an internal review should
be submitted within two months of the date of receipt of the response to
your original communication and should be addressed to [Birkbeck, University of London request email].


If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
