You requested details of the annual charge for Facilities Management to
GLQ and/or FES FM for the financial years 2015/16 & 2016/17.
We consider that your request relates to environmental information and as
such falls within the exemption in section 39 (2) of the Freedom of
Information (Scotland) Act 2002 and that your request should be
considered under the Environmental Information (Scotland) Regulations 2004
(EIRs).
In terms of the EIRs this is information that we do not hold and therefore
cannot provide as per Regulation 10 (4) (a). By way of explanation this
charge forms part of the Unitary Charge payable by the College on a
monthly basis. These payments include facilities management costs but
these are not separately disaggregated. Further information on the
payments made in relation to our Riverside Campus for 2015/16 and for the
future is contained in our Annual Accounts at Note 14. Theses are
available on our website but for ease of reference we have provided you

“Reserves Policy’

The foundation has also committed to make instalments totalling £127,000 in relation to the project management costs project which was granted in December 2014 following an application by the City of Glasgow College.

It further notes 'that the timing of these payment is set out in the Grant Agreement entered into by the Foundation and the City of Glasgow College.'

Therefore The City of Glasgow College has entered into an agreement with the Foundation being a third party Company limited by Guarantee, however you the college yourselves have entered into a legally binding grant agreement to provide payment for services to City of Glasgow College, a Public Body which has a legal duty in upholding standards of transparent and accountable integrity, therefore disclosure of this information is crucial to allow a clear and transparent understanding of how the public pound is being spent.

Additionally I would cite I would cite The Information Commissioner Office’s Statement:
“You must also make your staff, contractors, customers or others you have contact with aware of how the Act may affect them. You should make it clear that you cannot guarantee complete confidentiality of information and that as a public body you must consider for release any information you hold if it is requested.”

As such if the college have received funds from the foundation to cover the cost of facilities management, then the agreement to pay the FM contractor must be between the College and the Contractor not the Foundation and the Contractor.

Therefore please now disclose the information I have requested.

I am writing to request an internal review of City of Glasgow College's handling of my FOI request 'Facilities Management Costs'.

The exemption in section 39(2) which you have applied is essentially a technical provision. It creates an exemption from disclosure under FOISA where information is environmental information as defined in
the EIRs. It allows you the college to manage the complex relationship between these two laws, both of which give individuals rights to request environmental information.
By using the Exemption under section 39(2), you the college can go on to consider whether the information needs to be disclosed solely in terms of the EIRs.

If the information falls within the definition of environmental information, you the college have
both an obligation and an option. You have the obligation of dealing with the request under
the EIRs , which I would respectfully request that you do.

There is a separate statutory right of access to environmental information available to the public therefore it is in the public interest to respond to this the request in line with the EIRs. Please note that this exemption is subject to the public interest test, please now respond to this request under EIR’s.

Following the public interest factors, favour of disclosure should be applied per the following line of reasoning’s:
Transparency and accountability,
promoting a public understanding,
safeguarding democratic processes,
securing the best use of public and environmental resources
any suspicion of wrong doing.

your review request:
We have double checked the link provided and it does provide access to our
Annual Report and Accounts.
You make reference to the Foundation's Reserve Policy (your email of 12

Glasgow College. This is correct but you should note that these sums
relate to project management costs and not facilities management costs,
which was the focus of your initial request for information. Therefore
this information is not relevant in relation to your request.

per the narrative you provide in your email of 16 June 2017.
