Facial Recognition Use and Related Documentation

Response to this request is long overdue. By law, under all circumstances, Dyfed Powys Police should have responded by now (details). You can complain by requesting an internal review.

Dear Dyfed Powys Police,

Please could you confirm if the force is using live and/or retrospective facial recognition technology, or is planning to in the next 12 months?

If you are using facial recognition, which supplier(s) have you contracted with?

Please share copies of your policy, standard operating procedure and DPIA along with any other related documentation.

Yours faithfully,

Fred Wright

FOI, Dyfed Powys Police

Good morning,

Reference No: 413/2022

Thank you for your request for information dated and received by the
Freedom of Information Unit 11/05/2022 concerning Facial Recognition
Technology.

This request is being handled under the Freedom of Information Act 2000.

Dyfed-Powys Police can confirm that it does hold some of the information
covered by your request; however we believe that we need further time in
which to provide a full response to you.

We consider that the following exemption of the Freedom of Information Act
may apply to the information in part:

Section 31(1)(a)(b) Law Enforcement

(1)    Information which is not exempt information by virtue of section 30
is exempt information if its disclosure under this Act would, or would be
likely to prejudice –

(a)    The prevention or detection of crime

(b)    The apprehension or prosecution of offenders

Sections 31 is a prejudiced-based qualified exemption and there is a
requirement to articulate the harm that would be caused by disclosing the
information, as well as carrying out a public interest test in order to
establish whether the public interest in maintaining the exemption may be
outweighed by a wider public benefit in disclosure.

We now need further time in which to consider the public interest in
disclosing the information. We will endeavour to provide you with a
response as soon as possible and in any case by 08/07/2022. Should there
be any further delay we will write to you accordingly.

If you are unhappy with the way your request for information had been
handled, you can request a review by writing to the freedom of information
unit address supplied on the attached appeal process document.

If you remain dissatisfied with the handling of your request or complaint
