Under the Freedom of Information Act please advise the following:

1) Please provide a list of educational establishments using facial recognition for students 18 and under.

2) Please provide your advice to companies which are providers to schools and schools/educational establishments wishing to use facial recognition technology. (This would include advice ref GDPR and Data Protection Act 2018).

3) Please advise if you have been approached by any companies wishing to supply facial recognition to schools and provide all communications you have had with them, this includes all communications, i.e. minutes of meetings, letters, emails, video calls, etc.

4) Please advise if your office has examined or have any details of standards any facial recognition hardware and software to be used in educational establishments.

fraud and cybercrime reporting centre. If your organisation is in
Scotland, then reports should be made to Police Scotland.

If you are a Communications Service Provider reporting a security breach
under the Privacy and Electronic Communications Regulations – you will

Thank you for your email.

In my response I did suggest some ways that you might refine your request
so that we can search for information held without breaching the s.12
costs limit.

With regards to question 2 & 3, the problem is that relevant
correspondence could be held within our case files, both for complaints
and where we have been approached for advice and we do not have a way to
search for the content that you’re looking for other than through manual
searches.

If you are aware of specific organisations which you believe may have
contacted us about this it would be helpful if you could provide their
names, then we would be likely to be able to conduct electronic searches
against the names of the organisations.

If you are unable to provide names I would suggest limiting your request
so that it would not catch all correspondence which may be held in
relation to complaints and advice cases. I have suggested a way to redraft
your questions below:

2) Please provide any standard advice or policies/ guidance you have
produced for companies which are providers to schools and
schools/educational establishments wishing to use facial recognition
technology. (This would include advice ref GDPR and Data Protection Act
2018).

3) Please advise if you have conducted any policy advisory work, research
or consultations with companies wishing to supply facial recognition to
schools and provide all communications you have had with them, this
includes all communications, i.e. minutes of meetings, letters, emails,
video calls, etc.

Please note that I have not conducted any searches based on this and
cannot advise you whether or what we hold, however we would be able to do
these searches without breaching the s.12 costs limit.

and schools/educational establishments wishing to use facial recognition
technology.  (This would include advice ref GDPR and Data Protection Act

'Professor Fraser Sampson reflects on the publication of the CoP APP on Live Facial Recognition.

Whether it’s in our streets, supermarkets or (heaven forfend) our schools, how to deal with Live Facial Recognition (LFR) is the surveillance question that won’t go away.

I was therefore pleased to see the publication of the College of Policing Authorised Professional Practice on Live Facial Recognition which sets out a commitment to ‘lawful and ethical’ use of this technology.'

'Live facial recognition technology guidance published

Live facial recognition technology supports police to prevent and detect crime and make people safe. It involves using cameras in public or private areas to find passing individuals who are included on police databases. The software generates an alert, which is reviewed manually by a police officer before a decision is made to engage with the individual.'

ICO (31/1/23):

'We have issued a letter to North Ayrshire Council (NAC) following their use of Facial Recognition Technology (FRT) to manage ‘cashless catering’ in school canteens.

The story was first brought to us in October 2021 when NAC introduced FRT into nine of its schools. NAC stopped processing shortly after data protection concerns were raised with us. '
