Extraction of information from PSNI

where is it stated that NIPSO cannot request information unless in the course of an investigation, please advise what action can be taken when this policy is not adhered to. As NIPSO were not investigating Radius Housing Association at that time, advise would be appreciated as to why they were asking PSNI then.
In fact, NIPSO did not investigate Radius Housing Association in any substantive manner, or the Armagh City Banbridge and Craigavon Council for that matter.

I refer to your further request for information dated 13 June 2023 which
was submitted by you in reply to our response to your previous information

You have requested the following:
“…So why did the legal department get the information re 23 December and 7
January 2022, when there was no investigation ongoing. In fact, there was
no investigation at all. This will be raised as a new request.”
This will be dealt with as a request for information under Section 1 of
the Freedom of Information Act 2000.
However, under section 1(3) of the Freedom of Information Act 2000 we are
not obliged to respond to this request if we require further information
in order to identify and locate the information requested. In order that
we may deal with this matter correctly, kindly clarify precisely what you

No further action will take place in this matter until you have clarified

Information Act 2000.

Mr Smythe is a condescending and very rude man. He questions me, a professional journalist, at every twist and turn. He questions my technical ability, wastes my time, and is a thoroughly unpleasant person. Never mind, he has been reported to the Fraud Squad. He does not even know what the Human Rights (Northern Ireland) 1998 is, let alone how to implement it. Two years later, he is still protesting in vain that he has done nothing wrong by colluding with PSNI.

I am writing to request an internal review of Northern Ireland Public Services Ombudsman's handling of my FOI request 'Extraction of information from PSNI'.
Refuse to explain why they colluded with PSNI, refuse to explain why they failed in their statutory duties to investiate Radius Housing Association and the local Council. Refused to explain why they found it necessary to contact my MP, or adhere to the law.

NIPSO keep saying the matter is closed. It is not closed until the ICO, the Fraud Squad and I say so.

I believe I have explained it well enough. I would ask that NIPSO do not waste my time in prevaricating, especially as they have still not adhered to legislation regarding my SAR.
If a substantive response is not received, it wil be classed as refused, and sent to the ICO.
