Extension to Spousal visa

Dear Home Office,

My husband has his first 33 month spousal visa which expires on 19 Jan 2019. We will be visiting South Africa for Christmas in Dec 2018.
Based on the UKBA website saying he can only apply 28 days prior to expiry, this means he can only apply on 22 Dec 2018 when we are out of the country.

Can he apply earlier, some reports suggest you are allowed to apply after you have been in the country for 30 months? He arrived on 26 April 2016 which would suggest he could apply after 26 Oct 2018?

Dear Letitia Meadows Petzer

Thank you for your enquiry dated 11th August regarding the earliest to
extend a spousal visa.

Yes the recommendation is 28 days before it expires however you can put an
application in three months before hand. However doing so will effect
future application for settlement. Applying to extend a spouse visa early
means that instead of extending once before applying for settlement, you
would have to extend a second time, which would be costly.

It would also not be a good idea to apply early, as if your application is
delayed, you would be unable to travel, as traveling during applications,
would result in it be canceled and the fee being lost.

Depending on when you are due back in the UK, you could apply on your
return, providing that your current visa is still in date, with the latest
date to submit being the 18th by next day recorded delivery.
