Extension of Piloted Pathway for Autism and ADHD Assessments

Dear Humber and North Yorkshire Integrated Care Partnership,

I am writing to request information around the decision to extend the piloted pathway with regards to adult access to autism and ADHD assessment.

Please provide:
• The most recent draft of the IAI, covering the decision to extend the pilot.
• Full minutes of the ICB Board Meetings, either in draft or ratified form, including written records of the closed sections relating to Autism and ADHD
• The specific date the decision was taken to extend the pilot
• Any written documents, including draft notes and emails regarding extending the pilot: detailing the rationale for doing so, and measures taken to address risk
• Documentary evidence (including drafts) of discussions whereby it was agreed that the pilot did not pose a significant risk, with regard to the likely impact on patient safety or care
• Up-to-date copies of the minutes from the Quality Committee to show where the statutory and quality issues raised by the pilot have been addressed.

Procurement:
Please provide the Tender Notice with accompanying services specifications, used in the procurement of Adult Autism and ADHD Services since April 2021
Please provide documentary evidence of the agreement to waive standing orders in respect of the procurement of Adult Autism and ADHD Services from March 2023
Please supply a copy of the original Do-IT Solutions contract and the written agreement to extend the pilot.

Please also provide the following data protection assurances:
• Documentary evidence that the commissioned pathway meets Data Security and Protection Duties: e.g., via The Data Security and Protection Toolkit
• A Data Protection Impact Assessment to cover the initial and extended pilot period
• Please substantiate claims that the profiler does not make automated decisions
• Please provide an up-to-date copy of the ICB digital consent policy.

I am writing to request an internal review of Humber and North Yorkshire Integrated Care Partnership's handling of my FOI request 'Extension of Piloted Pathway for Autism and ADHD Assessments', with particular focus on the application of FOIA exemptions under sections 21 and 22.

With regards to section 22, I believe the public interest test has overlooked some important points in favour of disclosure of the "Integrated Impact Assessment (IIA), which includes an Equality Impact Assessment (EIA), [which] was initiated as part of the
project to ensure that the pilot activity helped to promote equality, challenge discrimination and is accessible to all. " You state that "The IIA continues to be developed as the pilot progresses." You will be aware that ICB has an obligation to complete the assessment in full before beginning a pilot. At this point the document must be made public, meaning that it is over six months overdue.

You recognise that "there is in general a strong public interest in information being made as freely available as possible, in transparency and accountability, and to promote public understanding." This being the case, the reasons given to maintain the exemption do not meet the threshold for withholding statutorily required information. Moreover, each further month that the ICB claim that the information is incomplete, therefore should not be released, compounds the breach of duty of care. With this in mind, to claim that "releasing information ahead of its planned publication date could lead to disruption of the communications plan and put duplicated or inaccurate information within the public domain" is insufficient. The same argument would apply to the Data Protection Impact Assessment, which you cite as being in progress. As part of reviewing your decisions, please release the drafts, notes or correspondence about ALL such assessments relating to equality, risk and data impact.

In the case of the section 21 exemption, thank you for providing details of how I may access parts of the tender information that requested. However, I would question whether the information is, as required by the ICO when applying a Section 21 exemption, “reasonably accessible” because it requires the individual to sign up for an account on an inaccessible online tender system. As a result, please consider whether this information could be provided via another means, ideally digitally, in response to this email.

This being so, I would be grateful if you could review your decisions and provide the information directly.
