Expenses and Hospitality

The request was successful.

Dear United Lincolnshire Hospitals NHS Trust,

can you please send me a copy of your reply to an FOI request about 3 years worth of bonuses and expenses for staff/ceo and executive directors, that was sent around the end of November to NHS Trusts.

Do you have Gifts, Hospitality and Sponsorship Policy or similar and a Code of Conduct and can you please email me a copy.
Can you send me a copy of your register for 2008/9 showing details of Gifts, Hospitality and Sponsorship.

Yours faithfully,

Gerry Hallright

Dear Jayne Warner,

thank you for your reply and searching your records for a previous FOI.

I believe it was a Mr Lotinga who requested the FOI information in 4 parts covering bonuses and expenses paid and cars used by Trust aroudn the end of November 2009. I would be grateful if you can see if this additional information matches information you have.

In addition to the Hospitality policy, I requested a listing of items on your Hospitality, Gifts and Sponsorship register for 2008/9. Can you please now send me a copy.

Yours faithfully,

Gerry Hallright

Dear Jayne Warner,

thank you for your reply and the attached documents.

I have attached some extracts from NHS related governance documents, which I believe show a presumption and requirement of disclosure of details on a register.

I do realise there can be concerns around DPA issues.
Can I suggest an amended request in which you exclude the names of employees that are on the register and send me the remaining information.

Could you please leave any Directors names or titles on the register as I think there would be a reasonable expectation that these details would be disclosed in line with disclosure of Directors remuneration.
If you decide not to supply the Director details, please supply the register details without any employee details.

Yours faithfully,

Gerry Hallright

NOLAN PRINCIPLES

Openness
Holders of public office should be as open as possible about all the decisions and actions they take. They should give reasons for their decisions and restrict information only when the wider public interest clearly demands.

COMMERCIAL SPONSORSHIP – ETHICAL
STANDARDS FOR THE NHS, NOV 2000

Paragraph 19
ensure all sponsorship deals are documented through use of a register or simple ledger, held by the employer e.g. the Health Authority, NHS Trust or Primary Care Trust, which can be audited as appropriate. In order to demonstrate openness, it is essential that the Register should be available on request to the public and be made available at all HA board meetings.

Government Response to the Health Committee's Report on the Influence of the Pharmaceutical Industry , Feb 2007

We believe that monitoring of dealings between NHS staff and business can only be successfully carried out at local level. The Department of Health has issued two sets of guidelines on these issues, the 'Standards of Business Conduct for NHS Staff' published in 1993, and 'Commercial Sponsorship - Ethical Standards for the NHS' published in 2000.

These guidelines cover situations where NHS employees should declare any business or financial interests they may have. It also advises NHS employers to establish a register of interests so that employees can declare casual gifts or hospitality received.

This should be audited as appropriate, and be available on request to the public. Employers can more effectively monitor the implementation of this guidance, and take appropriate action where this is required.

Dear Mr Hallright,

I write in reference to your complaint made through the United Lincolnshire Hospitals NHS Trust
website.

I am sorry that there has been the delay between your follow-up Freedom of Information request and
the Trust’s reply however a review of our system has not been able to identify a previous record of
the follow up correspondence which you attached to your email of complaint. In order that I may look
into this further I would therefore be grateful if you could forward me copies of the original follow-up
requests which includes details of the email addresses they were sent to.

I note that you have previously used the assistance provided via the “What do they know” website
as a means of submitting requests. I am aware that there have been some occasions in the past
where that website’s link to the trust was different to the Trust’s dedicated FOI email address. For your
reference the address for all FOI requests is foi@ulh.nhs.uk

I have reviewed the register of gifts and hospitality for 2008/09 and in response to your request
provide the entries made in year with names removed.

Chairman: Paul Richardson

I trust that this information assists you with your enquiries. I will, of course, be happy to respond
further regarding the receipt of the original follow-up request once I am in possession of the additional
information requested above, however, for completeness I would also advise that should you not be
content with the outcome of your complaint, you may apply directly to the Information Commissioner
for a decision. Generally, his office cannot make a decision unless you have exhausted the
complaints procedure provided by United Lincolnshire Hospitals NHS Trust. The Information
Commissioner can be contacted at: The Information Commissioners Office, Wycliffe House, Water
Lane, Wilmslow, Cheshire SK9 5AF.

Dear Mr Napier,

thank you for your recent letter and the information which was attached.
This covers all the items I was interested in.

I have come across a small number of incorrect FOI addresses on the whatdoyouknow website and apologise if this caused some confusion and additional work for the Trust.
I have checked and the foi@ulh.nhs.uk email address is now listed on this website.

Yours sincerely,

Gerry Hallright
