Thank you for your request for information about exemption certificates.
Your request was received on 24/06/2011 and I am dealing with it under the
terms of the Freedom of Information Act 2000.

Dear Mr Norris,

I have now conducted an Internal Review regarding your request for
information about exemption certificates.

I can confirm that I am partially upholding your Appeal. Please find my
explanation for this below.

Your request:

Please provide a list of all requests made for an Exemption Certificate
between April 2010 and April 2011. Please indicate which requests have
been accepted and which were rejected along with the reason for the
rejection. Can you also provide a clear reference number so that copies
of any certificates issued may be requested at a later date.

Our response:

We provided you with a spreadsheet consisting of the following fields of
information: exemption certificate number, the date issued, the
department, the relevant section and the project title, along with the
following note: that we do not record the reason for the final decision as
there is no requirement for Chief Officers to record their comments on the
form, only to sign their Approval (or not).

Your appeal:

Thank you but there is no indication as to which requests have been
accepted and which were rejected. Can you please supply this information
as requested, or were they all accepted?

Following the receipt of this appeal I have contacted the Corporate
Procurement Department and they have confirmed that the reason that we did
not provide the information as to which exemption certificates were
accepted and which were rejected, was that the information was not held in
a central location at the time of the request. To explain the Exemption
request forms are issued by Corporate Procurement, but the final decision
for an Exemption to become valid is made by the Directors of the various
departments.

It would have exceeded the statutory 18 hours cost limit for this
information to have been provided at the time of your request, due to the
information not being centrally recorded. I apologise that this
information was not made clear within our original response to you.

If you have specific individual exemption certificates that are of
interest to yourself, I would advise you to make a new request specifying
which certificates you are interested in and we will consider this
request.

For your information there is an exercise being completed by the
Procurement Department to record this information centrally. They are
conducting an exercise across the Directorates to chase all outstanding
applications that have been made in the last financial year, with a view
to obtaining an update of the status of their Exemption request.

This internal review is now closed. If you have any queries about this
email, please do not hesitate to contact me.

Commissioner for a decision.
