Freedom of Information – Information Request
Regarding your Freedom of Information request, we have reviewed this
request and have estimated that the cost of retrieving the information
requested would exceed £450. Section 12 of the Freedom of Information Act
allows public authorities to levy a charge or refuse to respond to a
request if the cost of responding is greater than £450.
This estimation was arrived at by taking into consideration the following
activities that we would have to undertake in order to fulfil your
request:
o determining whether we hold the information;
o finding the requested information, or records containing the
information;
o retrieving the information or records; and
o extracting the requested information from the records.
In line with guidance from the Information Commissioner’s Office regarding
Freedom of Information requests we have estimated the time spent
retrieving the information requested in relation to your request by
equating one hour of work per person to a cost of £25. This means that
the time limit for the request is 18 hours and as the request currently
stands, we would exceed this. Star Academies have calculated that
sourcing and extracting the information for points one, two, and three of
your request would require 18.5 hours of work. Information relating to
point four is held by schools rather than centrally (we have 20 secondary
schools) and it would take a member of staff at each of our secondary
schools an hour to source and extract this information.
In addition to the above, we are also concerned that some of the fields in
the spreadsheet you have provided are so specific, and the numbers
potentially inputted into these fields so small, that we would need to
consider whether, in some cases, this would risk the possible
identification of certain pupils at our schools. If the data could lead
to the identification of a pupil, we would be required to consider whether
the provision of such information would beach principle one of the UK GDPR
– fairness, lawfulness, and transparency.
Naturally we do want to cooperate with your request as far as possible,
however, we would need you to considerably narrow the parameters of your
request (e.g., reducing the number of academic years information has been
requested for, removing point four, reducing the number of fields on the
spreadsheet etc.). As per guidance from the Information Commissioner’s
Office in their Guide to Freedom of Information ([1]Guide to freedom of
information | ICO) we are able to refuse to respond to your request in its
current form as it breaches the cost limit.
In line with guidance from the Information Commissioners Office if you
refine your request, we will treat it as a new request.
If you are unhappy with the service that you have received in relation to
your request and wish to request a review of the decision, you should

Thank you for your reply. Your response indicated that providing the information I asked for in my original request would exceed the appropriate time/cost limit. I have therefore reduced my request in scope by requesting data from academic years, rather than terms, and from years 9-11 together, rather than each year group separately. I have also amended the question re: fixed-term exclusions of 5 days or more, to just fixed-term exclusions as recorded by your academies.

code and by SEN category).

o All figures below 5 will be suppressed to avoid any risk of
identification.
o SEN categories include the following (pupils without SEN, pupils with
SEN (K), pupils with EHC Plan (S)).

Thank you for your request for information from Star Academies, which we
received on Thursday 14th April 2022, regarding exclusions data.
In my email, dated Thursday 10th March 2022, declining your previous
request for information as it would have breached the cost limit, I
advised that Star Academies would be happy to provide a subset of the
data. The information I advised that we would be happy to supply was as
follows:
• Number of pupils recorded on roll in years 9-11, broken down by
declared ethnicity code (the snapshot date would be the January School
Census - Thursday 20th January 2022).
• For the academic year 2021/22, data regarding suspensions recorded to
date:
◦ Total number of suspensions recorded (broken down by ethnicity code
and by SEN category).
◦ Total number of permanent exclusions (broken down by ethnicity code
and by SEN category).
I also advised that all figures below 5 would be suppressed to avoid any
risk of identification and that SEN categories would include the following
pupils:
• Pupils without SEN.
• Pupils with SEN.
• Pupils with an EHC Plan.
To align our snapshot information as closely as possible with your
original request, please note that the information that we have supplied
in relation to the total number of suspensions recorded (broken down by
ethnicity code and by SEN category) and the total number of permanent
exclusions (broken down by ethnicity code and by SEN category) relates to
years 9-11.
Please note that we have supplied a Trust level, rather than a school
level, snapshot. This approach has allowed us to include figures below 5
as the risk of any possible identification is reduced. Please note that
we have not included information relating to Oulder Hill Leadership
Academy in tables 1, 2, and 3 of the Trust level snapshots as we do not
hold census data in relation to the school, which only joined Star
Academies on Tuesday 1st March 2022. Census information in relation to
Oulder Hill Leadership Academy, which was previously known as Oulder Hill
Community School and Language College, is available from the Department

To reduce the numbers of exclusions and suspensions in our academies Star
Academies has implemented the following:
• A Behaviour Policy which incorporates early identification of pupil
needs including a graduated response with external agencies and
experts.
• Reasonable adjustments for pupils with SEND in terms of adaptive
teaching but also to sanctions and rewards.
• Specialist provision for pupils who struggle to self-regulate where
their needs can be more appropriately supported including 1:4 adult to
pupil ratios, reduced class sizes, and tailored educational offers
• A move towards relational practice with all schools expected to
demonstrate unconditional positive regard
• Suspensions and exclusions as a last resort with different options
explored such as logical consequences, reparation, partnership working
with local schools etc.
Regarding our response we are only providing the data relating to the
current academic year, as sourcing, retrieving, and extracting the
information you requested relating to exclusions and suspensions covering
2017-17, 2018-19, and 2019-20, would have taken more than 18 hours of work
time and led us to breach the cost limit.
If you are unhappy with the service that you have received in relation to
your request and wish to request a review of the decision, you should

If you are not content with the outcome of your review, you may apply
