I refer to a recent Freedom of Information request, RFI20120675.

In her disclosure, Ms Wright wrote "... we hold information which contains the underlying data assumptions used to calculate the evasion rate. However this information does not exist in the form of a written explanation but rather in the form of a complex spreadsheet containing various formulas and data sets which would be unintelligible without significant additional explanation".

Since you hold information which contains the underlying data assumptions used to calculate the evasion rate, please make that information available. I understand it is in the form of a spreadsheet which may be unintelligible, but I accept the risk. The BBC's concept of "unintelligible" may not be the definitive one.

It can't be unintelligible if TV Licensing can understand it. I mean they employ some of the least intelligent people on the planet.

I would add that they have already confirmed that the information exists in a readily accessible (spreadsheet) format, so unless they're going to trot out a refusal notice using some obscure exemption they really have no excuse for not responding. In fact the law is such that they should have responded in full anyway by now, regardless of their intent to disclose.

Ah, but this is the BBC we're dealing with. It regularly breaks the law by refusing to respond promptly and again by refusing to respond within 20 working days. It will then issue an insincere and insubstantial apology for an apology (of which the above is an example), and that will make law-breaking OK. Of course, if YOU break the law by watching live TV without having the State's permission then the BBC will take you to court. Double standards? I think so.

The reason this spreadsheet was withheld originally was that it is unintelligible without further explanation. That was the sole reason given. The spreadsheet exists, and it doesn't require any collation of more material from various other sources. It should have been released before now. I hope the BBC will not try playing the old "detection and/or prevention of crime" card. That really would look as if it had something to hide.

Dear Ms Wright,

Thank you for the information you have provided in the form of the Excel workbook "TV Licences In Force and Evasion Statistics".

Regrettably, I am unable to examine the formulas used in the calculations, nor am I able to carry out "what if" scenarios. This is because all the worksheets comprising the workbook are locked and password protected.

I have read through the accompanying Final Response but cannot find the passwords anywhere in that document.

Are you able to provide the necessary password(s) in response to this message, or is a further FoI enquiry necessary?

Original xls file opens fine with Open Office and formulae made visible by going to Tools > Protect Document and unchecking Sheet/Document. No passwords required.
