EU Residence card for fiancé(e)s after marriage under Surinder Singh route
Dear Home Office,
I understand that provisions have been made for and proposed civil partners of EEA nationals paragraph 290 to apply under the Surinder Singh route subject to the payment of the visa fees in force.
However, nothing is mentioned on the immigration status of such persons once in the UK and after the marriage or civil partnership has taken place. Would they be eligible for an EU residence card, or would they have to apply for the more stringent leave to remain as the spouse of a British citizen?
Kindly provide a comprehensive response as this situation is not addressed any where in your publications.

Thank you for your email.
I am not entirely sure if I understand your query .
Paragraph 290 is regarding approval under the Immigration Rules to enter the United Kingdom and take part in a marriage or civil partnership .
I am not sure where you and your partner are living at present.
A British National cannot exercise their Treaty Rights in the United Kingdom so would be unable to sponsor anyone under the European Rules , they would need to apply under the Immigration Rules .
