Dear FOI Enquiries,

So you are unable to confirm that you took out 141million in loans from the EU as reported by the times in 2008.

Do we the people who fund the BBC not have a right to know about any loans that may create bias with the BBC.

If loans are received from the EU a political organisation does this not go against the royal charter to which the BBC is subject?

Dear David,

I refer to your email below and having looked into this, I can confirm
that all the loans referred to in the Times article were made to
commercial subsidiaries of the BBC (which, as previously mentioned, fall
outside of the scope of the FOI Act) and were therefore excluded from
the original response.

Dear David,

I am sorry that this part of your request, as to whether or not the
BBC's commercial subsidiaries are in breach of the BBC's Royal Charter
in receiving EU loans, was not addressed and now respond as follows:

The BBC's commercial subsidiaries are required to be organisationally
separate from the BBC and are businesses which operate with a view to
making a profit. In the course of normal business operations such
companies may require loan facilities which will be sought on the most
suitable terms for business purposes. The loans from the European
Investment Bank were sought and provided on a normal commercial basis;
accordingly the transactions do not involve any infringement of
applicable rules whether under the BBC Charter or otherwise.

If you remain dissatisfied with this response, the appeal rights set out
at the bottom of our response to RFI20101695 apply.
