Dear Wirral Borough Council,

I would like to know how much the Council has spent outsourcing to either Barristers Chambers or Solicitors at Employment Tribunals for all Council Staff (including Teaching Staff). Any combination of those below, between 1st August 2000 and the 31 October 2010:

1) For constructive dismissal
2) Unfair dismissal
3) One (or more) of the various discrimination claims and/or under the Protection from Harassment Act
4) Public Interest Disclosure Act 1998
5) Any other Employment issues, I may have omitted.

Please name the Solicitors/Barristers that the Council have outsourced to: For example, 2010 Number Name.

I would request that you include VAT in the figures Please provide the figures in the following format e.g. 2006 – NUMBER HERE; 2007 – NUMBER HERE; 2008 – NUMBER HERE; 2010 – NUMBER HERE; etc, thus making it easier for one to read and to ensure there is no misunderstandings.

Please also send this information as "calendar years".
Please note that I do not seek or require any personal information such as names and addresses – only the total figures.

I would ask that you remember the statutory duty imposed upon public authorities by virtue of Section 16 of the Freedom of Information Act to provide advice and assistance to requesters. If for any reason you are leaning toward rejecting any part of this request or if you plan to argue that it is unmanageable or unanswerable in any way then I would expect you to contact me promptly to find ways to answer this request to our mutual satisfaction.

Thank you for your request for information below; our legal team will
require an extension to the 20 working day timeline to identify and
extrapolate the information you have requested. One of our solicitors
will undertake a review to ascertain the number of cases relating to the
heads of claim mentioned and then consider the level of detail
available; some information may be unavailable, due to the passage of
time - but we will notify you, if this is the case.

I can confirm that a preliminary response will be provided by 25
February 2011 and I trust this is acceptable to you.

Dear Jane Corrin

Please explain why you require an extension of 20 days? When councils twice the size of Wirral Council have already provided the correct information. Without the need for an extension.

Is it normal council procedure for FOI requests to be vetted by a solicitor? The information I requested is basic clerical research.I suggest you contact the director of Finance Ian Coleman, he can ask one of the clerical staff to run a report on the database and I am sure they will find the correct information, as all council financial procedures have to be adhered to.

Please remember the format is: Year, Total cost, Name of Solicitor/Barrister, no additional information is required.

Dear Wirral Borough Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Wirral Borough Council's handling of my FOI request 'ET Costs'.

Section 16 of FOIA imposes a duty to provide advice and assistance. Yet Wirral Council have not done so. Wirral Council have done nothing to assist me in seeking to find a way that would help me obtain the information I am requesting. Therefore, if the
information exists, Wirral Council are required to disclose it unless an exemption applies.
Wirral Council have done nothing to assist me in seeking to find a way that would help me obtain the information I am requesting.

Therefore the only conclusion I can draw is that Wirral Council are purposefully seeking to conceal the number of cases that have been outsourced to Barrister/Solicitors within their organisation.

I refer to your request for information made on 15 January 2011. I have
been asked by Mr Surjit Tour, the Head of Legal and Member Services to
respond to your request , which was as follows:

 

I would like to know how much the Council has spent outsourcing to either
Barristers Chambers or Solicitors at Employment Tribunals for all Council
Staff 9including Teaching Staff). Any combination of those below, between
1 August 2000 and the 31 October 2010:

5)Any other Employment issues, I may have admitted.

 

 

Section 84 of the Freedom of Information Act 2000 defines “information” as
meaning “information recorded in any form”. Having made inquiries I must
inform you that the Council does not hold any recorded information in
respect of how much the Council spent between 1 August 2000 and  31 March
2006 on outsourcing employment  tribunal matters, as the Council’s
financial system  was changed in the financial year commencing 1 April
2006, and the previous financial system is not accessible. The manual
files are no longer available under the Council’s retention policy.

 

However, I am able to provide information in respect of the years
2006-2010 and this information is presented in calendar years as
requested.

 

All the payments made between 2006 and 2009 were made to a barrister
practising from 7 Harrington Street, Liverpool. In 2010  the sum of £2700
plus VAT of £525 was made to a barrister practising at Atlantic Chambers
Liverpool. This payment of £2700 is included in the figure of £10,087.51
shown for 2010. The balance of the £10,087.51 was paid to the barrister
from 7 Harrington Street. You indicated that you were not seeking personal
information in respect of these payments. No matters in respect of
Employment Tribunals were outsourced to external solicitors. I enclose the
information you were seeking in respect of 2006-2010.

 

I apologise for the long delay in responding to your original request.
