Thank you for your request for information as copied below. You asked the
House of Commons seven questions about contracts in place for the
provision of Facilities Managements services to the House, which we have
sought to answer below.

 

Please note that whilst the House of Commons and House of Lords are two
separate public authorities for the purposes of the Freedom of Information
Act 2000 (FOIA), information on facilities managements services provided
to Parliament is held bicamerally between the two Houses. Therefore, this
response covers both Houses of Parliament. 

 

     1) Please could you confirm if there are existing contracts for the
provision of Facilities Management services for the House of Commons
Property/Estate or if this service is delivered by in-house teams?

     2) If there are contracts in place, please could you advise the
following:

          a) Contract start & end dates?

          b) Extensions available to the contracts, including any
extensions already taken?

          c) Total contract value?

          d) Incumbent supplier(s)?

   and

          f) Who the Senior Responsible Owner for the contracts is?

 

We have interpreted your questions to mean details of any existing
contracts we have in place for the provision of facilities management
services to the House.  Please understand that these are managed by the
in-house teams of the House of Commons such as In House Services and
Estates (IHSE) and the Parliamentary Maintenance Services Team (PMST).

 

This information is held by the House of Commons. We hold contract details
for facilities managements services used by the House at the time of your
request. These include the name and reference number for these services
along with the details specified, and the information we hold is provided
in the spreadsheet attached.

• Provision of Duct Cleaning and Industrial Cleaning Services
• Provision of Maintenance and Support Services for the Great Clock of
the Palace of Westminster
• Management, Collection and Disposal of Waste from the Parliamentary
Estate

 

We do not hold service specification documents for the remaining
contracts. Copies of the specifications we do hold are attached. Please
note that due to the file size limit for sending emails, these documents
will be sent over a number of emails.

 

Please note that some information within these documents has been withheld
in accordance with sections 40, 24, 31 and 38 FOIA. Details of these
exemptions are provided below.

 

Section 40 – Personal information

 

Some part of these documents contain the personal information of House of
Commons staff as well as private individuals, and this information has
therefore been withheld in accordance with section 40(2) FOIA, as the
disclosure of this information would not be consistent with the data
protection principle found in Article 5.1(a) of the UK General Data
Protection Regulation (UK GDPR). This is an absolute exemption and the
public interest test does not apply.

 

Section 24 – National security

 

Additionally, some parts of these documents contain specific details of
our security measures as well as details of non-public areas of the
parliamentary estate, as well as some details of our cyber security
processes. We have concluded that withholding this information is
necessary for the purpose of safeguarding national security. This
information is therefore exempt by virtue of Section 24 FOIA. This is a
qualified exemption and the public interest test applies.

 

We have considered the public interest in disclosing this information. The
House of Commons is a vital part of the UK’s democracy and interacts on a
daily basis with a number of important institutions, including the UK
Government. Members of HM Government, such as the Prime Minister, the
Cabinet and junior ministers, as well as non-political civil servants,
routinely visit and/or work on the parliamentary estate. There is
therefore a public interest in the public being reassured that the House
of Commons has appropriate security systems and procedures in place to
ensure the safety of those individuals. Likewise, as our security measures
are financed by the public purse, there is a public interest in
understanding that they work effectively and are value-for-money.

 

However, we have also considered the public interest in withholding this
information. Parliament continues to remain under threat from malicious
groups and fixated individuals looking to target the estate, who may do so
in a number of ways including targeting specific areas of the estate for
attacks, disrupting core parliamentary processes related to legislation,
and numerous others. Releasing details about our security measures however
(both physical and those relating to cyber security) would help malicious
groups and individuals to circumvent them.  While some details may not
seem harmful in isolation, it would be likely to help build a greater
understanding of our measures, allowing the more effective targeting of
individuals or our premises. Likewise, this would also apply to the
release of non-public areas, as this would allow them to more easily be
targeted as well as increasing the likelihood of attacks against them.

Ultimately, the release of this information would be likely to deter both
visitors and pass holders from attending the estate, in particular if any
information released related specifically to locations of individuals.
Likewise, it may lead to parliamentary IT systems being affected or
compromised. In either instance, this would disrupt the ability of
Parliament to function, affecting legislative proceedings and other core
parliamentary functions. It would also have a knock-on effect for
government departments and their functions, in particular those relating
to parliamentary proceedings.

 

For these reasons, we have concluded that the public interest in
withholding the information outweighs the public interest in disclosure.

 

Section 31 – Law Enforcement

 

We also consider that disclosing the same information would be likely to
prejudice the prevention or detection of crime and the apprehension of
offenders. This information is therefore also exempt by virtue of section
31(1)(a) and (b) FOIA. This is a qualified exemption and the public
interest test applies.

 

We have considered the public interest in disclosing this information. The
release of details of non-public areas within this spreadsheet would
provide the public with a greater insight into the parliamentary estate,
in particular gaining a greater understanding of the logistics and
resources needed for the legislative process. The disclosure of
information about our security measures would help to show the extent to
which Parliament ensures the safety of those on the estate, which would
naturally reassure the public at large as well as people working on or
visiting the estate. As before, Parliament is financed via the public
purse and there is therefore a public interest in knowing that public
funds spent, in this instance on maintaining security measures, are
cost-effective, proportional and appropriate.

 

However, we have also considered the public interest in withholding this
information. Releasing information which could give access to non-public
areas of the estate would be likely to increase attempts by criminals to
target these areas, particularly areas which are not public-knowledge. 
This would be likely to lead to greater crime as the security of the
estate is compromised. Specific, descriptive details about these areas
would allow criminals to gain a greater understanding and overview of
their layout, in turn allowing them to more easily navigate the estate and
succeed in their actions if they were able to gain access. As before,
while certain details may seem innocuous on their own, they could be used
in conjunction with public knowledge or information from subsequent
requests to build a greater overview of non-public areas, thereby allowing
criminals to plan more effectively to target the estate. Likewise, details
of cyber security measures we use would better allow these same malicious
groups to target and undermine these measures, making Parliament much more
likely to be subject to cyber attacks as a result. By restricting the
release of this information however, we can ensure that potential
criminals are much more likely to be caught out by our security measures
and less likely to succeed in their plans as a result.

 

In these circumstances therefore, it is our view that the public interest
in maintaining the exemption outweighs the public interest in disclosing
the information. 

 

Section 38 – Health and Safety

 

These documents also contains information on security measures designed to
keep people safe on the parliamentary estate, and we consider that
disclosing this same information would be likely to endanger the physical
and mental health of individuals, as well as their safety, so this
information is exempt by virtue of sections 38(1)(a) and (b) FOIA. This is
a qualified exemption and the public interest test applies.

 

We have considered the public interest in disclosing this information. The
parliamentary estate is an important historical, political and
constitutional site, and there is therefore a public interest in
understanding that it is safe and secure. Likewise, it is important for
the public to know that those who work or visit the parliamentary estate
can do safely and without fear of harm, and the release of this
information would reassure those looking to interact more with Parliament
that we have measures in place to protect their physical health of all
those who access the estate. The mental health of these persons may also
be reassured by the release of this information as they would be more
aware of the protections we have in place to ensure the safety of
passholders, making them more likely to want to interact with the estate.

 

However, we have also considered the public interest in withholding this
information. Parliament has a duty to ensure that the physical and mental
wellbeing of those who access the estate, including visitors, staff and
Members. It has a duty to ensure the safety of these individuals which
extends to the release of any information which may compromise this
safety. A safe and secure environment is a fundamental need for those on
the estate to ensure they can carry out their work without threat or fear
of violence.  However, the release of this information would be likely to
endanger the safety of those on the estate, because it would provide
details of our security measures to malicious groups/individuals, helping
them to circumvent them and compromising safety as a result. Furthermore,
this release of this information would also significantly harm the mental
wellbeing of those who use the estate. It would create a greater sense of
unease and vulnerability for those who access the estate, particularly for
Members, which would be likely to severely impact their ability to carry
out their duties as a result.

 

In these circumstances therefore, it is our view that the public interest
in maintaining the exemption outweighs the public interest in disclosing
the information.
