Freedom of Information Act 2000 – Information Request

 

Thank you for your request for information dated and received on 16
January 2013. The request has now been considered.

 

You asked:

 

Please provide the following information in relation to the 2010/11,

Our payroll has confirmed the following amounts which were paid out under
Essential Car User Payments:

 

2010/11 - Total Miles = 138,937

               Essential User allowance = £60,659.91

               Mileage = £74,339.57

 

 2011/12 - Total Miles = 135,728

               Essential User Allowance = £60,624.85

               Mileage = £68,272.54

 

2011/12 up to the end of January 2013

               Total Miles = 111,539

               Essential User Allowance = £46,249.15

               Mileage = £56,327.36

 

The number of individuals who were able to claim essential car user
payments for those years are:

 

            2010/11 - 66

            2011/12 - 51

            2012/13 (to date) – 49

 

Please note that these figures are for individuals and there are certain
posts which had more than one individual within a particular year.

 

We feel that more detailed information about individual posts would be
exempt from disclosure under Section 40(2) and (3) of the Freedom of
Information Act, Personal Information. We feel that detail of the
information requested is personal information as defined by Section 1(1)
of the Data Protection Act as it relates to an identifiable individual who
would be in a particular post. In coming to this conclusion we have also
considered the fact that essential car user status impacts on the
individual’s tax status.

 

We have therefore considered whether those individuals would expect their
information to be made public in this way. Car user status is not included
in job adverts or job descriptions and is therefore not already public
information. Therefore it is considered that the individuals concerned
would not necessarily expect their information to be disclosed publicly in
response to a Freedom of Information Act request.

 

With this in mind we believe that disclosure of detailed information could
result in the Council being in breach of the first principle of the Data
Protection Act. Therefore the exemption provided by Section 40(2) and (3)
of the Freedom of Information Act is engaged. As a absolute exemption we
are not obliged to consider the public interest test.
