Dear Department for Work and Pensions,

I have been informed that claimants suffering from a medically diagnosed neurological condition must be assessed by an Atos HCP who is a qualified doctor as opposed to a nurse or physiotherapist.

1. Is the above information correct?

2. Can you please provide me to the relevant DWP and or Atos document that clearly state this alongside the applicable page and subsection heading.

3. Does the DWP recognise the interchangeable definitions of Reflex Sympathetic Dystrophy, Complex Regional Pain Syndrome and Chronic Pain Syndrome as being neurological conditions that warrant examination by said Atos Doctor?

4. What would be the ramifications if assessed by an Atos HCP who was not a doctor e.g. would this be a breach of contract etc?

Dear DWP DWP Medical Services Correspondence,

Thank you for your further response concerning my FOI pertaining to ESA Assessment dated 10/05/12.

I am unsure why you have forwarded myself a further PDF concerning a list of neurological conditions and which type of HCP can assess said conditions. I was satisfied with the earlier response and so acknowledged this by marking my post ‘successful’.

1. Can you explain why my ‘successful’ response has been answered again?

2. Is there any significance between the two different types of pdf files that you have subsequently submitted (the written response appears to be duplicated) concerning the list of conditions. The dates are the same. The only difference I can discern is the latter pdf list is in a different format and the list is conjoined i.e. there is no clear distinction between who can assess what syndrome etc. Is this a result of text format confusing the lists.
