In public services a way of facilitating and evidencing compliance with the public sector duty is carrying out an Equality Impact Assessment prior to implementing a policy with a view to ascertaining it’s potential impact on Equality.

The public sector duty contained in section 149 of the Equality Act 2010 requires public authorities have due regard to a number of Equality considerations when exercising their functions.

Dear Governance,

1. Thank you for your response. The Equality Act 2010 removed the requirement to follow a prescriptive Equality Impact Assessment but not the requirement to demonstrate compliance. Could CAFCASS please demonstrate Equality Compliance in the development and implementation of the CIAF by providing the following information:

a. The record keeping process
b. Research/data gathered by NIS fieldwork
c. Consultations
d. Internal memo’s
e. Audit trail and all references to impact negative/positive on people with protected characteristics

and any other existence/forms of evidence of documentary information to demonstrate to the public that CAFCASS considered the impact of people with protected characteristics.

As CAFCASS can appreciate PSED expects public authorities to demonstrate due regard to disability/Equality. Disability was not given “due regard” to be included in the CIAF principles underpinning private law; but instead “disregard” by omitting it. Because disability has been disregarded could you please provide the information requested here. I understand that CAFCASS May see this as burdensome, overlapping etc but I am being persistent as I believe it is in the public interest that you provide this information given CAFCASS omitted disability in the CIAF.

Thank you for your email which let us know that you were unhappy with the
decision made in the FOI response of CAF 19-086 and requested a review of
the decision.

 

This  email serves to acknowledge that your request was received on 15
September 2019 and will be dealt with under the terms of the Freedom of
Information Act 2000.

 

A Senior Officer who was not party to the original decision on whether to
release the information will conduct the internal review. An internal
review involves a review of the decision on disclosure in the original
response and the way in which the request was handled. The internal
reviewer can either uphold or overturn the original decision.

 

Cafcass will notify you as to the final decision made regarding your
internal review 20 working days from receipt of your request.  You will
therefore receive a response on or before 11 October 2019.
