Rosemary Cairns, General Dental Council

Dear Mr Scorgie

I write further to my colleague Clare Mitchell’s email of 1 June
acknowledging your request for information made by email on 30 May 2016.

I can confirm that the GDC holds some of the information you have
requested.

As you know, the Freedom of Information Act 2000 (FOIA) obliges us to
respond to requests promptly and not later than 20 working days after
receiving a request.  However, when a qualified exemption (such as section
31) applies to the information and the public interest is engaged, the
FOIA allows the time for responding to be longer than 20 working days.  In
this case, because we have not yet reached a decision on where the balance
of the public interest lies, we will need some additional time to comply
with your request.

We estimate that it will take an additional 5 working days to make a
decision on where the balance of the public interest lies. Therefore, we
plan to let you have a response by 5 July.  If it appears that it will
take longer than this to reach a conclusion, we will keep you informed.
Alternatively, if we are able to reach a decision before this date, we
will of course let you know.

The specific exemption which applies in relation to your request is
section 31.  Section 31(1)(g) and 31(2)(i) apply to information the
disclosure of which would be likely to prejudice the exercise by any
public authority of its functions to secure the health, safety and welfare
of persons at work.

Yours sincerely
