Dear British Waterways Board,

Under the Freedom of information Act 2000, I would like you to provide details of the following for the years 2005 to 2012:

a) A Statistical breakdown of all sex, race and disability discrimination cases that have been brought against British Waterways by any of its employees during this period. ( Please include dates/outcomes and ethnicity of complainants )

b) Any Equality Targets that have been set for British Waterways by the Department for Food, Environment and Rural Affairs ( DEFRA ),within this timeframe, together with details of whether such targets were met.

c)Any guidance given by DEFRA as regards the Public Sector Equality Duty

d) Any memorandum of understanding between British Waterways and DEFRA

e) All Equality Impact assessments that have been carried out by British Waterways prior to all the redundancy processes during this period .

f) A breakdown of ethnic minority decision-makers involved in the redundancy selction processes during this period.

g) All agreements with any Unions in respect of the redundancy processes that occurred within this time frame.

h)Financial assistance from Central Government or other external funding bodies to support redundancy processes.

i)All business plans during this period

j) Any Race, Sex and Disability Equality Schemes that were implemented during this period.

k) Any briefing papers, board/committee minutes, company resolutions and internal memos that relate to disability and race discrimination.

l) Any contractual obligations ,in terms of equal opportunities law compliance, to external funders ,in particular the Big Lottery Fund, The Heritage Lottery Fund, The European Structural Fund (ESF) and Central Government.

m)African Caribbean Charities/voluntary/community groups British Waterways financially supported during this period.

n) In respect of (m) above, the named person/department/committee in charge of the processes and contact details of how such groups could have obtained financial assistance from British Waterways.

o)The Canal and River Trust's current Equality Officer/ Equality Champion.

p)The Canal and River Trust's current equal opportunities policy and statement

Please include all internal/external reports that relate to the above requests for information, including those reports in respect of the Audit Commission.

Information Request,

Dear Sir/Madam,

I am writing further to your requests for information received on 1st June and 6th June 2012.

Under section 12 of the Freedom of Information Act 2000, BW does not have to comply with a request for information where the cost of providing that information would exceed the “appropriate limit”. The Freedom of Information and Data Protection (Appropriate Limit and Fees) Regulations 2004 set the appropriate limit at £450 or 18 hours (based on a cost of £25/hour).

Regulations made under section 12(4) provide that where multiple requests are made to BW by one person within a 60 day period, the time taken to respond to these requests can be aggregated for the purposes of assessing whether the appropriate limit will be exceeded.

We have examined your request in detail and we estimate that the cost of identifying, locating, retrieving and extracting all the information that you have asked for in your requests is so very great that it would far exceed the appropriate limit and, therefore, we are unable to comply with these requests. To avoid this we would ask that you narrow the scope of your request. Your requests currently cover so many different aspects of the work that we undertake and relates to so several different parts of our organisation. If you were to narrow your request to cover only one aspect of equality within British Waterways or the Canal & River Trust (for example the Human Resources aspect of equality within BW only) this may enable us to respond within the appropriate limit.

If we haven’t reasonably met your expectations in relation to a request for information or you believe we may not have acted in accordance with the above legislation you should write in the first instance to Kelly Radley Head of Customer Relations, 64 Clarendon Road, Watford, Herts WD17 1DA outlining your concerns and asking for a review to be undertaken. Your correspondence will be acknowledged and a review of your case will be undertaken by one of British Waterways’ directors.

A formal review of the equal opportunities policy is currently being undertaken, a policy will be published once the review has been completed.

b) Please provide any Race, Sex and Disability Equality Schemes that British Waterways implemented during 2009-2012.
No race, sex or disability equality schemes were implemented during 2009 to 2012.

c) Please provide details of all Equality Impact assessments that have been carried out by British Waterways prior to all redundancy processes during 2009 -2012
Impact Assessments were carried out. We are aware that one was undertaken during the 2011 rationalisation programme.
