Thank you for contacting the Canal & River Trust with your request for information.

The extent to which the Freedom of Information Act applies to the Canal & River Trust is limited to those statutory functions which were transferred to it from British Waterways under the Transfer of Function order 2012. Broadly speaking these functions relate to the operation and maintenance of the Waterways under our control. You can view a copy of the Transfer of function order here:

As the Trust has no statutory obligation to provide long term or L6 moorings, Waterside Moorings (the commercial long-term mooring arm of the Trust which operates independently from our boat licensing functions) is relying on the Trust's land ownership rather than any statutory functions relating to the maintenance and operations of the waterway.

Therefore, our view is that your request for information does not fall within the scope of the Trust's obligations under FOI.
