An environmental search has been returned for the above site as "In Need of Further Assessment" due to there being a garage adjacent to the site between circa 1951 and 1984.
We would be grateful to receive written confirmation from you as follows:
1. That the council is aware of the past use of the area
2. That the council have not identified the study site or any surrounding areas as 'Contaminated Land' (as defined under Part 2A of EPA 1990).
3. That the council are not considering any action against the study site or any surrounding sites under this legislation.
We are aware that the study site was redeveloped as part of the Van Alen Building circa 2001 and would therefore assume that no further action is to be taken but we would greatly appreciate written confirmation as soon as possible.

Please find attached historical maps (OS Landmark) for 18 Camelford Street and nearby properties. The shaded properties on the 'current' map have been identified as potentially contaminated land sites due to their past commercial uses which may have resulted in some localised land contamination.
A previous report for Madeira Place is also attached which describes some of the other potentially contaminated land sites.
Similarly a previous report is attached about Van Allen Mews which contains information about the former garage site.
From the attached maps, it is clear that the Council is aware of the past use of the garage near to 18 Camelford Street. It was called Aquarium Garage and was risk rated as a Category C for further investigation. However, from the Van Allen report attached, it seems that there was remediation at this site prior to planning consent and it may therefore not be considered as potentially contaminated land.
There are approximately 3000 prioritised (potentially contaminated land) sites in Brighton and Hove with 3 or 4 category As (the highest priority) and approximately a 1000 Bs. Category E is the lowest priority for further investigation. Therefore, it is impossible to state when a Category C site, such as the former garage (now the Van Allen Building) would be investigated further.
Please note that regarding the previous garage and its derelict tanks, the current derelict tank register (Jan 2013) from East Sussex Fire and Rescue Service states for the Van Alen Building: ''All tanks were removed except one. This tank goes under the adjoining property and was left in place slurry filled''. This is also confirmed in the attached letter.

Regarding the specific questions outlined below, it can therefore be confirmed that neither the garage, nor any of the surrounding potentially contaminated land sites have been determined as Contaminated Land under the provisions of the Environmental Protection Act 1990.
The Council is not currently considering taking any action on the garage or other nearby sites.
