Dear Mr Silverman

We spoke yesterday as you called to follow up your recent FOI enquiry.

We covered a fair bit territory in our conversation but I was able to
confirm that we do not hold a list of the statutory undertakers with
respect to litter as designated by the Environmental Protection Act 1990.

I promised to let you have some further background info. Below you will
find links to the most recent figures that we have for fixed penalty
notices issued for littering by local authority enforcement officers.

Since the Defra website was improved it can be a bit difficult to easily
find the information you are after. However, scrolling down on the
following link you will find links to spreadsheets with information about
FPNs issued for litter. The most recent (and final) year that figures
were requested is 2008/09. As I said when we spoke yesterday these
figures give some useful information but they come with a bit of a `health
warning'. They were compiled through requests to local authorities to
provide the information but, despite repeated reminders, not all of them
provided returns and the Coalition Government has decided to end this
return to central government as an unnecessary data burden on local
authorities. The 2006/07 figures are considered to be the most complete
and indicate that around two thirds of the then 354 English local
authorities issued at least some FPNs for litter, with the grand total
coming to some 46,000 FPNs.

As you will see the bigger users tend to be London Boroughs and other city
areas but there is considerable use elsewhere, for example the east
midlands.
