I can confirm that Buckinghamshire Council does hold information falling

Data on the amount of requests for information that the council has
received in the past 12 months that have fallen under the Environmental
Information Regulations (2004), and that the council can charge for
supplying information. We have 217 cases recorded under EIR.

How many of these requests have the council actually initiated a charge
for providing the information. We have not charged for any requests under
EIR. However we have made information available through our paid for
services, the charges for which are advertised in our [1]schedule of
charges on our website.

I am writing to request an internal review of Buckinghamshire Council's handling of my FOI request 'Environmental information Regulations (2004) Charges'.

How many of these requests have the council actually initiated a charge
for providing the information. We have not charged for any requests under
EIR. However we have made information available through our paid for
services, the charges for which are advertised in our [1]schedule of
charges on our website.

I disagree with the above statement. If you are offering paid for services when someone has asked for a FOI request, or Environmental information request then a charge has been initiated for information.
You have actually asked me for a charge under : FOI 20840.

Dear Buckinghamshire Council,

This has undergone a review by Jennifer Green, but from the explanation given, although I have attached and there is a link through this email, she advises Findings of internal review –
We do not keep records when a request for information is received and the requester is subsequently referred to the schedule for fees and charges.

The response suggests non compliance and unless a response is fourth coming to the contrary I will have to take this up with the information Commissioners office.
Please advise if it is your intention to respond.
