I refer to your request for information submitted to Yorkshire Water dated

Please find attached the data we hold in relation to your request for the
manhole covers you identified.
For the correspondence requested as part of this request from residents
(complaints , emails, texts) in reviewing the information that you have
requested, we are satisfied that the information amounts to personal data
and should not be disclosed under Regulation 12(3) and 13. We are
satisfied that the disclosure of the information you have requested in
relation to this would allow the identification of an identifiable
individual(s). Secondly, disclosure of this information would contravene
principle a, of the Data Protection Act 2018 and GDPR, as there is no
lawful basis for this processing. Based on this we will not be able to
provide this information to you.”
We do not have a maintenance schedule or risk assessment for manhole
covers, we visit these reactively when an issue is reported. As such for
the purposes of paragraph 12(4)(1)(a), a public authority may refuse to
disclose information to the extent that (a) it does not hold that
information when an applicant’s request is received.
