On how many occasions in each of the last 10 years has EDDC's Environmental Health team:

1) commented on a planning application;
2) in their comment, raised concerns about noise levels from internal lifts;
3) addressed their comment regarding concerns about noise levels from internal lifts to proposed developments of 4 apartments or fewer.

I am writing to request an internal review of East Devon District Council's handling of my FOI request 'Environmental health, internal noise levels'.

The ICO guidance states: "Section 84 of FOIA defines “information” as: “information recorded in any form”. It is good practice to explain, if you can, why you consider that you do not hold the requested information. Clearly demonstrating why you do not hold a particular piece of information means the requester is less likely to ask for an internal review or complain to the ICO."

Your response has identified that you do hold the information and you have identified where, and your response also states that you do not keep records of the information requested. This does not make sense. Therefore, please provide me with the information that has been requested, as follows:

The number of occasions in each of the last 10 years that, where EDDC's Environmental Health team has commented on a planning application;
1) in their comment, they raised concerns about noise levels from internal lifts; and
2) in comments regarding (1) above, i.e. noise levels from internal lifts, their comment was addressed to proposed developments of 4 apartments or fewer.

The appropriate response, for example, might be, that EDDC's Environmental Health team has been consulted on 3724 occasions and replied 3661 times. Of those 3,661 occasions, X related to noise levels from internal lifts, and of those X occasions, Y concerned developments of 4 apartments or fewer.

The point is to establish whether EDDC's Environmental Health team has ever commented on the possibility of lift noise levels in very small developments. Your initial response makes clear that you hold the data. In line with ICO guidance, please now provide the data.

Dear Tony,

Thank you for your email. You have asked for an internal review of your
FOI response ref 665015804. I have reviewed your FOI enquiry, what was
sent to you and your email in response.

Your new request – The number of occasions in each of the last 10 years
that, where EDDC's Environmental Health team has commented on a planning
application;
1) in their comment, they raised concerns about noise levels from internal
lifts; and
2) in comments regarding (1) above, i.e. noise levels from internal lifts,
their comment was addressed to proposed developments of 4 apartments or
fewer.

Our response to this part of your original FOI request was that we do not
keep records of how many occasions these specific issues were raised.
Records of each individual application are however available on our
web-site at: https://planning.eastdevon.gov.uk/online...

To clarify, the information you are asking for is not held in a searchable
format and would require an officer to go through every single application
and pull out this detail. The planning applications are all published on
our website and you are therefore able to search for this information
yourself. You have asked for 10 years’ worth and this would constitute
potentially thousands of applications to search through individually. The
officer should have clarified this issue and I apologise that they didn’t
at the time.

However, we are still refusing your request on the grounds that it is
manifestly unreasonable under Regulation 12(4)(b) of the Environmental
Information Regulations, where dealing with your request would create
unreasonable costs and diversion of resources. To be clear the information
you seek may be noted in individual planning applications and as they are
published already on our planning portal we are not preventing you from
accessing this information. We are refusing your request as the time it
would take an officer to collate this data for you would be manifestly
unreasonable as it would place an unreasonable burden on our resources.

I hope I have been able to clarify our position on this matter. If you
