Dear Wirral Metropolitan Borough Council,

Further to the cancellation of Kingdom's contract, on 07th March 2019, can you please advise the following:

How many FPNs were outstanding as of 08th March 2019
How many FPNs have been paid since 08th March to current date
How many FPNs have been cancelled since 08th March, to current date.
How many FPNs have been referred to Magistrate's Court since 08th March.

Of the cases referred to court please advise the following:
How many were cancelled, on the day of the hearing, by WBC.
How many cases went ahead without the alleged offender attending.
How many were found guilty/to have committed the offence they were accused of, by the Magistrate.
How many were found, by the Magistrate, to have not committed an offence?

We write in response to your most recent Freedom of Information request in
relation to environmental fixed penalty notices (FPNs).  Please see our
response below.

 

 

Further to the cancellation of Kingdom's contract, on 07th March 2019, can
you please advise the following:

How many FPNs were outstanding as of 08th March 2019 - 666

How many FPNs have been paid since 08th March to current date (29^th May)
- 205

How many FPNs have been cancelled since 08th March, to current date. - 7

How many FPNs have been referred to Magistrate's Court since 08th March. -
380 matters referred to the Single Justice Procedure (SJP)*

 

Of the cases referred to court please advise the following:

How many were cancelled, on the day of the hearing, by WBC. - 21 paid to
withdraw, 2 withdrawn other reasons

How many cases went ahead without the alleged offender attending? Not
applicable – SJP is an administrative process

How many were found guilty/to have committed the offence they were accused
of, by the Magistrates. - 357

How many were found, by the Magistrate, to have not committed an offence?
- NONE

 

 

*Response compiled from Single Justice Procedure data for the period from
8^th March to 29 May (date of the enquiry), the information only relates
to the FPNs that were outstanding as of the 8^th March. All FPNs that
remain unpaid and not cancelled are forwarded to the courts for processing
via the Single Justice Procedure.

You say 380 were referred under SJP... You state this is an administrative process. Can you confirm how many of the 380 were advised of the date their case would be presented at the Magistrates Court?
