Environmental and climate change emergency reports

Dear Portsmouth City Council,

I would like to request the following under the Freedom of Information Act 2000

1) On 19th March 2019, PCC voted to declare a climate emergency. https://democracy.portsmouth.gov.uk/ieLi... The draft response of the council was put out for consultation on 4th February 2020 https://democracy.portsmouth.gov.uk/ieLi... I presume this response was formally accepted at some point. If this was done, which meeting was confirmed this decision?

2) The climate emergency response committed the council to publish an Annual review of the climate emergency around June 2021. Does this report exist?

3) As part of climate emergency, the council committed to "Provide an annual report on Portsmouth GHG emissions, what is working and what is more challenging and progress towards achieving net zero-carbon emissions." Do any annual reports on the climate emergency exist? (This might be the same document as the previous point 2).

4) Please send me the Air Qualty Annual Statement Reports for Portsmouth published in 2021 (which would be reporting for the data from period of calendar year 2020), if it exists.

5) Can you provide any plans or projections that detail when Horsea Island Country park will be open to the public? Additionally any reports about difficulties or delays to opening the park would be appreciated.

INFORMATION REQUEST ACKNOWLEDGEMENT
 
Thank you for your request for information received on 13th February 2022.
 
Your request will be considered in accordance with the Freedom of
Information Act 2000 (FOIA) or the Environmental Information Regulations
2004 (EIR) if it relates to environmental information as defined in
Regulation 2(1) of the EIR. Subject to the points made below, you will
receive the information requested as promptly as possible within the
statutory timescale of 20 working days.
 
If we need to obtain clarification from you to help us understand what
information you require, we will contact you as soon as possible. If this
is the case, the 20 working day time limit will not begin until the
necessary clarification has been received.
 
There are a number of lawful reasons why we may not be able to release
certain information. These reasons are referred to as 'exemptions' in the
FOIA or 'exceptions' in the EIR.  The Council will consider whether any of
these apply and, where required, will carry out a Public Interest Test to
decide whether information should be disclosed. If any information is to
be withheld, we will explain which exemption or exception applies. We may
be entitled to extend the deadline in certain cases, for FOIA this would
be to consider the Public Interest Test and for EIR where the request is
particularly complex or voluminous. In both cases we will be permitted to
extend deadline by a further 20 working days and will inform you if this
is the case.
 
The Council’s standard approach is to provide the information in the form
in which we hold it.  If you require an alternative format, for example,
an audio file, large print or information in a different language, please
let us know and we will provide it if reasonably practicable to do so.
 
There may be a fee payable for providing the information, for example, if
the cost of complying exceeds the appropriate limit set out in Section 12
of the FOIA or for photocopying or postage.   If a fee is to be charged,
we will send you a Fees Notice. Any fee must be paid before the
information will be provided.  The time between the issue of the Fees
Notice and receipt of payment will be excluded from the calculation of the
20 working day time limit.
 
Any personal information you provide us with will only be used to enable
us to comply with your request.

I write to communicate the outcome of the internal review of the council's
handling of your request for information.
 
Having reviewed our records, it would appear that the response to your
request was not sent as intended, for which I apologise most sincerely.
 
I am however able to provide the answers to your questions now and, in
accordance with the Environmental Information Regulations, confirm the
council holds in part the information you are seeking.

These "Annual Reports" are not held, however, the council produced its
[4]Climate Change Strategy and Carbon Budget for Portsmouth
 

 1. Please send me the Air Quality Annual Statement Reports for Portsmouth
published in 2021 (which would be reporting for the data from period
of calendar year 2020), if it exists.

 
Please see the attached draft document. 
 
 
The council has been liaising with DEFRA since January 2022 to finalise
this and it now remains subject to non-material changes. For example,
there may just be some adjustments to enable the document to be viewed on
mobile devices and some layout changes.
 

 1. Can you provide any plans or projections that detail when Horsea
Island Country park will be open to the public? Additionally any
reports about difficulties or delays to opening the park would be
appreciated.

 
The council is working with its contractors regarding the restoration of
the closed landfill site. This needs to be completed before any plans or
dates for the site can be confirmed.  At this time, the council does not
therefore hold the information you have requested.
