Environment Agency Short-Stay Moorings on River Thames

Response to this request is long overdue. By law, under all circumstances, Environment Agency should have responded by now (details). You can complain by requesting an internal review.

Dear Environment Agency,

May I suggest that this request may best be dealt with by your Operations Manager for the River Thames Navigation?

An Environment Agency paper issued on 27th November 2020 and entitled "Managing Environment Agency short stay moorings on the non-tidal River Thames" refers to a contract with a private company, District Enforcement Ltd, to manage these moorings and issue Penalty Notices to boaters exercising their right under the Thames Conservancy Act 1932 to moor overnight or for a reasonable time in the course of navigation.

Please provide a full and unredacted copy of the Contract made between the Environment Agency and District Enforcement Ltd for management of these moorings.

Should it be necessary, may I respectfully remind you that your prevarication on a previous FoI request for a copy of a similar Contract between the EA and Thames Visitor Moorings was ruled inappropriate? An internal review showed that there was absolutely no valid reason why a full copy of such a contract should not be supplied once it was in place.

You stated on 4th January that your response may have been delayed by the Covid emergency, which I understand, but that you would aim to respond by 18th January.

Review of Freedom of Information/Environmental Information Request
Request by Mr David Mercer in respect of information relating to contract details between
Thames Visitor Moorings and the Environment Agency dated 12 June 2018
I refer to your e-mail dated 12 June 2018, in which you advise us that you are appealing our decision
to refuse disclosure of information that you requested in your letter of 11 May 2018.
The Environment Agency received the request on 11 May 2018 and we responded to that letter on
11 June 2018.
Review
I have conducted an internal review which has concluded that the decision made to withhold some
information was correct at the time the decision was made but is now no longer sustainable given
the elapsed time. The exception applied to the information was that disclosure would adversely
affect the confidentiality of commercial or industrial information where such confidentiality is
provided to protect a legitimate economic interest. under Regulation 12(5)(e) of the Environmental
Information Regulations 2004 (EIR).
I have considered the public interest factors in favour of releasing or withholding information under
EIR Regulations. In reviewing our information, I am of the view that the original decision of ’..upon
assessing the factors in the public interest test, we have assessed that in relation to the
commercially confidential information we find that the factors in favour of withholding information
outweigh the public interest factors in disclosing the information.’, whilst correct at the time of the
decision is no longer sustainable given the time elapsed and delays in the tendering process..
I believe that, whilst correct at the time of issuing the response, as there have been delays in the
tendering process, it is no longer sustainable to withhold the requested information and I am
satisfied that it is in the public interest that the information be released.
Please find enclosed to this letter, the un-redacted version of the ‘pilot’ agreement between Thames
Visitor Moorings and the Environment Agency.
Payments made to Thames Visitor Moorings
Our records indicate that we have paid Thames Visitor Moorings £4850 for the period 1 November
2016 – 31 October 2017 and £2020 for the pilot extension from November 2017 to 31 March 2018.

We are therefore refusing to disclose this environmental information
requested because we have assessed exemptions to disclosure apply under
regulation 12(5)(e) of the Environmental Information Regulations 2004. As
a public body we are required under the Freedom of Information
Act/Environmental Information Regulations to give reasons for this
refusal.  We also need to show that we have considered the Public Interest
balance between refusal and disclosure.  You can find the details in the
appendix attached.

 

As we explained at the time, the internal review we carried out into our
response to your previous request for a copy of the contract between
ourselves and Thames Visitor Moorings, found that we were correct to
withhold some information as being commercially sensitive when we provided
our initial response. When reviewed at a later date, we considered that a
sufficient period of time had elapsed to enable the information to be
shared. We have redacted some of the information in the current contract
documentation on the same basis, which is that at the present time it is
commercially sensitive and therefore exempt under Regulation 12(5)(e) of
the Environmental Information Regulations 2004.

 

Please note the personal data of any third parties has also been redacted
from these documents. The Environment Agency is not able to disclose the
names of individuals who have communicated with the Environment Agency as
this is personal data under the Data Protection Act 2018 (DPA 2018) and to
disclose it would breach the First Data Protection Principle of the DPA
2018. 

 

The information requested is therefore exempt due to Regulation 13(1) of
the Environmental Information Regulations 2004, which explains that:

“To the extent that the information requested includes personal data of
which the applicant is not the data subject, a public authority must not
disclose the personal data if—

(a) the first condition is satisfied…”

The ‘first condition’ referred to above is further explained in Regulation
13(2A):

“The first condition is that the disclosure of the information to a member
of the public otherwise than under these Regulations—

(a) would contravene any of the data protection principles…”

 

The First Data Protection Principle requires that we are fair to
individuals when we collect and use their personal data.  In this case it
would be unfair to disclose information relating to an identifiable
individual as such individuals have a reasonable expectation that any
information held about them by the Environment Agency would remain
confidential. There is no requirement to conduct a public interest test
when refusing on this ground. 

 

I hope we have correctly interpreted your request.

Annex

 

Relevant exceptions

The exceptions that apply to the withheld information are:

 

Regulation 12(5)(e) of the Environmental Information Regulations 2004

EIR Regulation 12(5)(e) applies to the contract documents because
disclosure would adversely affect the confidentiality of commercial or
industrial information where such confidentiality is provided by law to
protect a legitimate economic interest.

 

The Public Interest Test  

We have weighed the public interest factors in favour of maintaining the
exceptions and find that they outweigh the public interest factors in
disclosing the information. In carrying out the public interest test we
have considered:  

 

1. Factors in favour of releasing the information: 

 

·                  General presumption of openness. The Environment Agency
would only withhold information if it is sure that disclosure would cause
substantial harm.

 

·                  General need to promote accountability and
transparency. 

 

·                  Whether the information is already public. In this
instance the information requested is not currently in the public domain.

 

·                  Contribution to sustainable development or public
health and safety. The interest here is in ensuring that the best
environmental options are being selected for this subject matter.

 

2. Factors in favour of withholding the information: 

    

·                  Prejudicing the effective running of the Environment
Agency or other public bodies due to the release of commercially sensitive
information.  

  

·                 Whether any other laws or legal principles would be
compromised. Disclosure of commercially sensitive information would
adversely affect the confidentiality of commercial or industrial
information where such confidentiality is provided by law to protect a
legitimate economic interest. The adverse effect is disclosure would give
unfair advantage to other companies taking part in future tenders.

 

As indicated, upon assessing the factors in the public interest test, we
have assessed that in relation to some information contained within the
contract specification documents, and in relation to the commercially
confidential exceptions, we find that the factors in favour of withholding
information outweigh the public interest factors in disclosing the

a full and unredacted copy of the contract made between the Environment
Agency and District Enforcement Ltd for management of boats moored to
Environment Agency land.

To compound their reluctance to provide all the information requested and the long delay before finally doing so, the Environment Agency chose to make the link to these documents available for only 30-days and thus not now available publicly to other interested parties.
That is unacceptable and the real reasons behind it can only be imagined.
