Ensuring customers are not subject to unnecessary recovery action, additional costs or hardship

The request was refused by Eden District Council.

Dear Eden District Council,

A council taxpayer who owes more than just the current year's liability runs the risk of incurring additional recovery costs through a further application for a liability order if payments which are intended for the current year's liability are allocated by the council's computer to the previous year's liability. This would most likely happen where a non specific payment is made and the computer software is set to automatically allocate these payments to the oldest year's debt.

Councils computer systems have the necessary flexibility to be set to allow non specific payments to be allocated to the arrears or the current year's liability.

I understand that the majority of billing authorities have their computer software set to ensure that their customers are not subject to unnecessary recovery action, additional costs or hardship, i.e. so non specific payments are allocated to the current year's liability.

How does Eden District Council have its computer software set to deal with non specific payments. Current or oldest year's liability?

Yours faithfully,

Gwyn Worth

Dear Eden District Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Eden District Council's handling of my FOI request 'Ensuring customers are not subject to unnecessary recovery action, additional costs or hardship'.

On 2 November 2017 you stated the following:

"We aim to respond to your request no later than 30 November 2017"

I have still no response.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/e...

Dear Gwyn

Further to our previous communication of 18 April 2018, please note that an 'internal review' refers to a review of a response by the Council to a request for information or to a refusal decision. As no response or refusal decision has been provided in this case, an internal review is not appropriate.

However, you may wish to submit a complaint to the Council that your request has not been responded to, in which case, please refer to the complaints procedure on our website: https://www.eden.gov.uk/your-council/hav...

You can also complain to the Information Commissioner (ICO) at: Information Commissioner’s Officer, Wycliffe House, Wilmslow, Cheshire SK9 5AF or by telephoning 0303 123 1113. Generally the ICO cannot make a decision unless you have exhausted the complaints procedure provided by Eden District Council.

Dear foi,

I am asking for this to be reviewed on the basis that the council is in breach of the legislation relevant to Freedom of Information and therefore consider it appropriate to do so.

Yours sincerely,

Gwyn Worth

Dear Gwyn

Thank you for your clarification. I can confirm that it is the Council's formal complaints procedure you require, which is a separate route to FOI. Therefore, please refer to our website for details of how to submit your complaint: https://www.eden.gov.uk/your-council/hav...

Dear foi,

Can you please deal with this appropriately as a Freedom of Information request.

Dear Gwyn,

Please note that an 'internal review' refers to a review of a response by the Council to a request for information or to a refusal decision. As no response or refusal decision has been provided in this case an internal review is not appropriate.

Please note that it is the Council's formal complaints procedure you require. Please refer to the complaints procedure on our website:
https://www.eden.gov.uk/your-council/hav...

You can also complain to the Information Commissioner (ICO) at: Information Commissioner’s Officer, Wycliffe House, Wilmslow, Cheshire SK9 5AF or by telephoning 0303 123 1113. Dear foi,

I will not be provoked into jumping through hoops and wasting the taxpayer's money of Eden and public money more generally by taking the approach you suggest. In fact, your approach tells me far more about Eden District Council than I would ever have found out if it had dealt with the request lawfully.

Yours sincerely,

Gwyn Worth
