Thank you for your reply of 15th June 2016 regarding my request for release of the DEP Final Report which was refused citing regulation 12 (5)(e) exemption on confidentiality grounds.

Before deciding whether to request an internal review of this decision, can I ask the CAA to release a copy of the specific non-disclosure agreement (NDA) between the CAA, NATS and DNV GL.

I note that the ICO guidance talks about not allowing "public authorities to contract out of their obligations under the EIR by inserting or accepting broadly drafted confidentiality clauses." and the EIR Code of Practice says :

Public authorities should reject such clauses wherever possible and explain
the relevance of the public interest test. Where, exceptionally, it is
necessary to include non-disclosure provisions in a contract, an option
could be to agree with the contractor a schedule of the contract that
clearly identifies information that should not be disclosed.

My primary interest is in understanding the significant noise impacts suffered by residents in East Teddington during the DEP trials. The CAA letter approving the trials noted that less overflight of Teddington would be expected but many people thought conditions deteriorated. It is possible that this is explained by the eastward movement of the 09RMID flights counteracting the expected westward movement of the 09RSAM flights (see Fig 4.6 of

However, it may be that certain, noisier classes of planes were unable to fly the more westward 09RSAM trial route and exposed East Teddington to louder,lower flights. This has not been reported in the Heathrow trial report, but I would have expected a more comprehensive, safety-related report from NATS to potentially discuss whether this is the case and present more detail on the actual heights and tracks flown (as the Helios report on the earlier easterly trials did :

Thank you for the copy of the unsigned, undated Multiparty Confidentiality Agreement that you supplied me with on 6th July.

I am writing to request an internal review of Civil Aviation Authority's handling of my FOI request 'Enhanced Route Spacing Guidance - DEP Final Report'.

As I mentioned in my email requesting a copy of the agreement, ICO guidance talks about not allowing "public authorities to contract out of their obligations under the EIR by inserting or accepting broadly drafted confidentiality clauses." and the EIR Code of Practice says :

Public authorities should reject such clauses wherever possible and explain
the relevance of the public interest test. Where, exceptionally, it is
necessary to include non-disclosure provisions in a contract, an option
could be to agree with the contractor a schedule of the contract that
clearly identifies information that should not be disclosed.

I would argue that the definition of Confidential Information in clause 1.1 of the agreement

(i) all information, data, know-how, formulae, processes, designs, photographs, drawings, specifications, software programs, samples,tools, analysis methods and other material attributable to or relating to the Permitted Purpose

is very much a broadly-drafted confidentiality clause. I fail to accept that such wording should defeat the public interest in understanding where types of aircraft actually flew during the DEP trials and the experimental basis for the safety implications inherent in the spacing of RNAV routes.

I would also ask you to consider whether the confidentiality exemption is applicable for a request concerning emissions (under Section 12(9)) of EIR. The Aarhus Convention which underpins EIR includes "Factors, such as substances, energy, NOISE and radiation, and activities or measures, including administrative measures, environmental agreements, policies, legislation, plans and programmes, affecting or likely to affect the elements of the environment" in its definition of environmental information.
