Dear Hastings Borough Council,

On the 23rd June 2021 HBC refused an EIR request for "Copies of all correspondence (in any form) between HBC and other external bodies providing date and title" for Enforcement Query ENF/20/00325 under exception 12(5)(b) "Course of Justice"

Following this refusal HBC has changed its position on several similar EIR requests that were refused under EIR. These requests were taken to the ICO and during the ICO investigation HBC decided that exception 12(5)(b) "Course of Justice" no longer applied due to the passage of time. HBC then released the information previously requested but refused under exception 12(5)(b) "Course of Justice". The ICO noted that:

"I understand from the council that after it has reconsidered its position as regards your request, it has now written to you disclosing the information you requested, with only personal data redacted. ... as the council has now withdrawn its reliance upon the exemption in Regulation 12(5)(b)"

The EIR requests concerned were:

.FOIR -254681446 - Balconies at Rocklands - ICO - Case Reference IC-94018-R3L4
.FOIR-243122424 - Rocklands Enforcement complaint EN/19/306 - Case IC-92596-L8R4 - course of justice

Enforcement Query ENF/20/00325 has now been closed and the same passage of time has now occured as the requests listed above and exception 12(5)(b) can no longer apply. I therefore request under EIR the following information for Enforcement Query ENF/20/00325 - Rocklands - access ramp and road:

Copies of all correspondence (in any form) between HBC and other external bodies
providing date and title
Copies of all internal correspondence (in any form) between HBC officers
providing date and title
