Thank you for your email dated 26 March 2014.
You have asked us to provide documentation in relation to the enforcement of Ombudsman Services final decisions. We do not have this available. We do, however, have a process in place if a participating company does not implement a final decision.
When we issue a final decision it is binding on the participating company; it has 28 days to implement the remedy. If the complainant advises that the remedy has not been implemented within our timescales, we work with the complainant and the company to ensure the remedy is implemented without any further delay. If the company fails to implement the remedy we will involve the regulator.
You have also requested an email address for Freedom of Information requests. We are not subject to Freedom of Information requests as we are not a public body.
Section 3 of the Freedom of Information Act 2000 sets out that a public authority, as defined in that Act, is either listed in Schedule 1 of the Act, it is designated by order of the Secretary of State under Section 5 or it is a publicly owned company as set out in Section 6. Ombudsman Services is not defined as a public authority under any of those categories at present.
